11 The Committee on Judiciary (Campbell) recommended the
12 following amendment:

14 Senate Amendment (with title amendment)
15 On page 2, between lines 7 and 8,
16
17 insert:
18 (4) A product seller may be liable as a manufacturer
19 if:
20 (a) The manufacturer has no identifiable agent,
21 facility, or other presence in the United States;
22 (b) The manufacturer is not subject to service of
23 process on any state in which the action could have been
24 brought and service cannot be secured by a Florida long-arm
25 statute;
26 (c) The manufacturer is otherwise immune from suit; or
27 (d) The court determines that the person is or would
28 be unable to enforce a judgment against the manufacturer. For
29 purposes of this paragraph, the statute of limitations and
30 statute of repose applicable to a claim asserting the
31 liability of a product seller are tolled from the date of the

1 filing of a complaint against the manufacturer to the date
2 that judgment is entered against the manufacturer.
