2An act relating to podiatric medicine; amending s.
3461.014, F.S.; requiring a hospital having a podiatric
4residency program to annually provide the Board of
5Podiatric Medicine with certain information; increasing
6the time allowed for a resident to continue as an
7unlicensed resident; permitting a resident podiatric
8physician to prescribe certain medications under certain
9circumstances; providing a penalty; requiring the board to
10adopt rules to administer this act; providing an effective
11date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  Section 461.014, Florida Statutes, is amended
16to read:
17     461.014  Residency.--
18     (1)  The board shall encourage and develop podiatric
19residency programs in hospitals in this state and shall
20establish such programs by the adoption promulgation of rules,
21subject to the following conditions:
22     (a)(1)  Any residency program shall be approved by the
23Council of Podiatry Education of the American Podiatry
24Association.
25     (b)(2)  A residency program may be established only at a
26hospital where a duly licensed podiatric physician is on the
27hospital staff or is otherwise in a supervisory position.
28     (c)(3)  Every resident shall register with the board
29through the submission of forms provided by the board, which
30forms shall, besides other required information, reflect the
31date of commencement of residency.
32     (d)(4)  Every hospital having a residency program shall
33annually, on semiannually, on January 1 and July 1 of each year,
34provide the board with a list of podiatric residents and such
35other information as is required by the board.
36     (e)(5)  A No program in residency may not shall allow a
37resident to continue as an such, unlicensed resident, for an
38aggregate period of time in excess of 3 2 years.
39     (f)  A person registered as a resident podiatric physician
40under this section may, in the normal course of his or her
41employment, prescribe medicinal drugs described in schedules set
42forth in chapter 893 if:
43     1.  The person prescribes such medicinal drugs through use
44of a Drug Enforcement Administration number issued to the
45hospital or teaching hospital by which the person is employed or
46at which the person's services are used.
47     2.  The person is identified by a discrete suffix to the
48identification number issued to such hospital.
49     3.  The use of the institutional identification number and
50individual suffixes conforms to the requirements of the federal
51Drug Enforcement Administration.
52     (2)  Any person who willfully violates this section commits
53a misdemeanor of the first degree, punishable as provided in s.
54775.082 or s. 775.083.
55     (3)  The board shall adopt rules pursuant to ss. 120.536(1)
56and 120.54 as necessary to administer this section.
57     Section 2.  This act shall take effect July 1, 2005.
