14 On page 43, line 28 through page 46, line 2, delete
15 those lines

17 and insert:
18 Section 11. Paragraphs (a), (b), (gg), (hh), and (jj)
19 of subsection (1) of section 216.011, Florida Statutes, are
20 amended, paragraphs (rr) and (ss) are added to that
21 subsection, and paragraph (c) is added to subsection (3) of
22 that section, to read:
23 216.011 Definitions.--
24 (1) For the purpose of fiscal affairs of the state,
25 appropriations acts, legislative budgets, and approved
26 budgets, each of the following terms has the meaning
27 indicated:
28 (a) "Annual salary rate" means the monetary
29 compensation authorized to be paid a position on an annualized
30 basis. The term does not include moneys authorized for
31 benefits associated with the position. In calculating salary

1 rate, a vacant position shall be calculated at the minimum of
2 the pay grade for that position.
3 (b) "Appropriation" means a legal authorization to
4 make expenditures for specific purposes within the amounts
5 authorized by law in the appropriations act.
6 (gg) "Mandatory reserve" means the reduction of an
7 appropriation by the Governor or the Legislative Budget
8 Commission due to an anticipated deficit in a fund, pursuant
9 to s. 216.221. Action may not be taken to restore a mandatory
10 reserve either directly or indirectly. "Performance-based
11 program appropriation" means the appropriation category used
12 to fund a specific set of activities or classification of
13 expenditure within an approved performance-based program.
14 (hh) "Budget reserve" means the withholding, as
15 authorized by the Legislature, of an appropriation or portion
16 thereof. The need for a budget reserve may exist until certain
17 conditions set by the Legislature are met by the affected
18 agency, or such need may exist due to financial or program
19 changes that have occurred since, and were unforeseen at the
20 time of, passage of the General Appropriations Act.
21 "Performance-based program budget" means a budget that
22 incorporates approved programs and performance measures.
23 (jj) "Program" means a set of services and activities
24 undertaken in accordance with a plan of action organized to
25 realize identifiable goals and objectives based on legislative
26 authorization.
27 (rr) "Activity" means a unit of work which has
28 identifiable starting and ending points, consumes resources,
29 and produces outputs.
30 (ss) "Qualified expenditure category" means the
31 appropriations category used to fund specific activities and

1 projects which must be transferred to one or more
2 appropriation categories for expenditure upon the
3 recommendation by the Governor or Chief Justice, as
4 appropriate, and subject to approval by the Legislative Budget
5 Commission.
6 (3) For purposes of this chapter, the term:
7 (c) "Statutorily authorized entity" means any entity
8 primarily acting as an instrumentality of the state, any
9 regulatory or governing body, or any other governmental or
10 quasi-governmental organization that receives, disburses,
11 expends, administers, awards, recommends expenditure of,
12 handles, manages, or has custody or control of funds
13 appropriated by the Legislature and:
14 1. Is created, organized, or specifically authorized
15 to be created or established by general law; or
16 2. Assists a department, as defined in s. 20.03(2), or
17 other unit of state government in providing programs or
18 services on a statewide basis with a statewide service area or
19 population.
20 Section 12. Effective July 1, 2006, paragraph (n) of
21 subsection (1) of section 216.011, Florida Statutes, as
22 amended by section 11 of this act, is amended to read:
23 216.011 Definitions.--
24 (1) For the purpose of fiscal affairs of the state,
25 appropriations acts, legislative budgets, and approved
26 budgets, each of the following terms has the meaning
27 indicated:
28 (n) "Expense" means the appropriation category used to
29 fund the usual, ordinary, and incidental expenditures by an
30 agency or the judicial branch, including such items as
31 contractual services, commodities, and supplies of a

1 consumable nature, current obligations, and fixed charges, and
2 excluding expenditures classified as operating capital outlay.
3 Payments to other funds or local, state, or federal agencies
4 may be included in this category.
