  1                      A bill to be entitled

  2         An act relating to behavioral health service

  3         delivery; amending s. 394.9082, F.S.; requiring

  4         the Department of Children and Family Services

  5         to enter into a noncompetitive contract with

  6         the North East Florida Addictions Network to

  7         establish a single managing entity for

  8         districts 2, 3, 4, 12, and 13, to deliver

  9         substance abuse services to recipients of child

10         protective services in the five districts;

11         requiring the department and the North East

12         Florida Addictions Network to develop and

13         implement a plan that allows the phase-in of

14         services beginning with the delivery of

15         substance abuse services; requiring the

16         department to initiate implementation of the

17         substance abuse delivery component of this

18         program without delay in the expansion

19         districts and furnish status reports to the

20         appropriate substantive committees of the

21         Senate and the House of Representatives by

22         specified dates; requiring the department to

23         monitor and evaluate the expansion project;

24         providing an effective date.

26  Be It Enacted by the Legislature of the State of Florida:

27  

28         Section 1.  Subsection (8) of section 394.9082, Florida

29  Statutes, is amended to read:

30         394.9082  Behavioral health service delivery

 1         (8)  EXPANSION IN DISTRICTS 2, 3, 4, AND 12, AND

 2  13.--The department shall expand its pilot program work with

 3  the North East Florida Addictions Network community agencies

 4  to establish a single managing entity for districts 2, 3, 4,

 5  and 12, and 13 accountable for the delivery of substance abuse

 6  services to child protective services recipients in the five

 7  two districts. The purpose of this strategy is to enhance the

 8  coordination of substance abuse services with the North East

 9  Florida Addictions Network, community-based care agencies, and

10  the department. The department shall work with affected

11  stakeholders to develop and implement a plan that allows the

12  phase-in of services beginning with the delivery of substance

13  abuse services, with phase-in of subsequent substance abuse

14  services agreed upon by the North East Florida Addictions

15  Network the managing entity and authorized by the department,

16  providing the necessary technical assistance to assure

17  provider and district readiness for implementation. When a

18  single managing entity is established and meets readiness

19  requirements, The department may enter into a noncompetitive

20  contract with the North East Florida Addictions Network

21  entity. The department shall maintain detailed information on

22  the methodology used for selection and a justification for the

23  selection. Performance objectives shall be developed which

24  ensure that services that are delivered directly affect and

25  complement the child's permanency plan. During the initial

26  planning and implementation phase of this expansion project,

27  the requirements in subsections (6) and (7) are waived.

28  Considering the critical substance abuse problems experienced

29  by many families in the child protection system, the

30  department shall initiate the implementation of the substance

31  abuse delivery component of this program without delay and

 1  furnish status reports to the appropriate substantive

 2  committees of the Senate and the House of Representatives no

 3  later than February 29, 2004, and February 28, 2005, and

 4  February 27, 2006. The integration of all services agreed upon

 5  by the managing entity and authorized by the department must

 6  be completed within 2 years after initiation of the expansion

 7  project initiation. Ongoing monitoring and evaluation of this

 8  strategy shall be conducted in accordance with subsection (9).

 9         Section 2.  This act shall take effect July 1, 2005.
