5 | Between line(s) 996 and 997, insert: |
6 | Section 7. (1) There is established the Lobbying Study |
7 | Group, consisting of nine members. The Speaker of the House of |
8 | Representatives shall appoint three members, one of whom shall |
9 | be a lobbyist; the President of the Senate shall appoint three |
10 | members, one of whom shall be a lobbyist; and the Governor shall |
11 | appoint three members, one of whom shall be a lobbyist. The |
12 | members shall serve for a term of 1 year each and submit a |
13 | report to the Speaker of the House of Representatives, the |
14 | President of the Senate, and the Governor by July 1, 2006. |
15 | (2) The study shall include, but not be limited to, the |
16 | following areas: |
17 | (a) The prohibition of lobbyists either to give gifts or |
18 | to give gifts under current limits with dual reporting. |
19 | (b) The prohibition of lobbying of parties or candidates |
20 | to: |
21 | 1. Make campaign contributions or solicitations for |
22 | contributions prior to qualifying; or |
23 | 2. Make campaign contributions during any meetings of the |
24 | Legislature, including interim committee meetings. |
25 | (c) The prohibition of legislative members from working |
26 | for an entity or government agency that employs a lobbyist or |
27 | that seeks appropriations. |
28 | (d) The prohibition of legislators from requesting from a |
29 | registered lobbyist or principal any funds for any purposes, |
30 | including charitable causes, without the legislator filing a |
31 | quarterly disclosure statement listing lobbyists that were |
32 | contacted. |
33 | (e) The prohibition of any legislator from soliciting for |
34 | a 527 from a lobbyist or principal without the legislator filing |
35 | a quarterly disclosure statement listing the lobbyist that was |
36 | contacted. |
37 | (f) The prohibition of campaign consultants from working |
38 | as a lobbyist or registering to lobby for 2 years after they |
39 | have had a contract for payment for campaign consulting with a |
40 | legislator or party. |
41 | (g) The prohibition of legislators' spouses and immediate |
42 | family members lobbying while such legislator is in office. |
43 | (h) The prohibition of in-kind contributions to any |
44 | political party from lobbyists or principals for any travel, |
45 | dining, or entertainment, including the use of any facilities |
46 | owned, leased, or under the control of the lobbyist or |
47 | principal. |
48 | (i) The prohibition of elected public officials from |
49 | soliciting or receiving federal or state campaign contributions |
50 | while serving as a state elected official. |
51 | (j) The prohibition of legislators, state parties, or |
52 | state appointed officials from recommending to any entity a |
53 | lobbyist for hire. |
54 | (k) A $100 expenditure limit per person for all food and |
55 | beverage consumed at one sitting. The reporting prohibition |
56 | against the listing of individual names would remain. The |
57 | lobbyist or principal must be in attendance at the event. |
58 | (l) The requirement of a "check-off" disclosure of areas |
59 | of lobbying interest in a timely manner on the lobbyist |
60 | disclosure statement either at registration or, in the case of |
61 | amended activities, within 48 hours of commencement of lobbying |
62 | activity. |
63 | (m) The requirement of exact dollar disclosure by the |
64 | lobbyist of all fees paid by public entities to the lobbyist. |
65 | (n) The requirement of audits of lobbyist records only |
66 | after an affirmative finding of probable cause on a filed |
67 | complaint. |
68 | (o) The requirement of electronic reporting, without |
69 | signatures, the use of the same opt-out as the executive branch, |
70 | and to require due dates to be the same as elections law, less |
71 | frequently during the interim. |
72 | (p) The prohibition of registered lobbyists from personal |
73 | campaign contributions unless the lobbyist is eligible to vote |
74 | for the candidate or lives in the district. |
75 | (3) This section applies to lobbyists to the legislative |
76 | and executive branches of state government and to local |
77 | governments. |
