3     Amendment to Amendment (751873) (with directory and title
4amendments)
5Between line(s) 996 and 997, insert:
6     Section 7.  (1)  There is established the Lobbying Study
7Group, consisting of nine members. The Speaker of the House of
8Representatives shall appoint three members, one of whom shall
9be a lobbyist; the President of the Senate shall appoint three
10members, one of whom shall be a lobbyist; and the Governor shall
11appoint three members, one of whom shall be a lobbyist. The
12members shall serve for a term of 1 year each and submit a
13report to the Speaker of the House of Representatives, the
14President of the Senate, and the Governor by July 1, 2006.
15     (2)  The study shall include, but not be limited to, the
16following areas:
17     (a)  The prohibition of lobbyists either to give gifts or
18to give gifts under current limits with dual reporting.
19     (b)  The prohibition of lobbying of parties or candidates
20to:
21     1.  Make campaign contributions or solicitations for
22contributions prior to qualifying; or
23     2.  Make campaign contributions during any meetings of the
24Legislature, including interim committee meetings.
25     (c)  The prohibition of legislative members from working
26for an entity or government agency that employs a lobbyist or
27that seeks appropriations.
28     (d)  The prohibition of legislators from requesting from a
29registered lobbyist or principal any funds for any purposes,
30including charitable causes, without the legislator filing a
31quarterly disclosure statement listing lobbyists that were
32contacted.
33     (e)  The prohibition of any legislator from soliciting for
34a 527 from a lobbyist or principal without the legislator filing
35a quarterly disclosure statement listing the lobbyist that was
36contacted.
37     (f)  The prohibition of campaign consultants from working
38as a lobbyist or registering to lobby for 2 years after they
39have had a contract for payment for campaign consulting with a
40legislator or party.
41     (g)  The prohibition of legislators' spouses and immediate
42family members lobbying while such legislator is in office.
43     (h)  The prohibition of in-kind contributions to any
44political party from lobbyists or principals for any travel,
45dining, or entertainment, including the use of any facilities
46owned, leased, or under the control of the lobbyist or
47principal.
48     (i)  The prohibition of elected public officials from
49soliciting or receiving federal or state campaign contributions
50while serving as a state elected official.
51     (j)  The prohibition of legislators, state parties, or
52state appointed officials from recommending to any entity a
53lobbyist for hire.
54     (k)  A $100 expenditure limit per person for all food and
55beverage consumed at one sitting. The reporting prohibition
56against the listing of individual names would remain. The
57lobbyist or principal must be in attendance at the event.
58     (l)  The requirement of a "check-off" disclosure of areas
59of lobbying interest in a timely manner on the lobbyist
60disclosure statement either at registration or, in the case of
61amended activities, within 48 hours of commencement of lobbying
62activity.
63     (m)  The requirement of exact dollar disclosure by the
64lobbyist of all fees paid by public entities to the lobbyist.
65     (n)  The requirement of audits of lobbyist records only
66after an affirmative finding of probable cause on a filed
67complaint.
68     (o)  The requirement of electronic reporting, without
69signatures, the use of the same opt-out as the executive branch,
70and to require due dates to be the same as elections law, less
71frequently during the interim.
72     (p)  The prohibition of registered lobbyists from personal
73campaign contributions unless the lobbyist is eligible to vote
74for the candidate or lives in the district.
75     (3)  This section applies to lobbyists to the legislative
76and executive branches of state government and to local
77governments.
