  1                      A bill to be entitled

  2         An act relating to nursing home facilities;

  3         amending s. 400.141, F.S.; providing a method

  4         by which state-designated teaching nursing

  5         homes and affiliated assisted living facilities

  6         may demonstrate financial responsibility;

  7         providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Subsection (20) of section 400.141, Florida

12  Statutes, is amended to read:

13         400.141  Administration and management of nursing home

14  facilities.--Every licensed facility shall comply with all

15  applicable standards and rules of the agency and shall:

16         (20)  Maintain general and professional liability

17  insurance coverage that is in force at all times. In lieu of

18  general and professional liability insurance coverage, a

19  state-designated teaching nursing home and its affiliated

20  assisted living facilities created under s. 430.80 may

21  demonstrate proof of financial responsibility as provided in

22  s. 430.80(3)(h); the exception provided in this paragraph

23  shall expire July 1, 2005.

25  Facilities that have been awarded a Gold Seal under the

26  program established in s. 400.235 may develop a plan to

27  provide certified nursing assistant training as prescribed by

28  federal regulations and state rules and may apply to the

29  agency for approval of their program.

30         Section 2.  This act shall take effect upon becoming a

31  law.

 3    Provides for the indefinite effect of provisions, slated
      to expire July 1, 2005, which allow state-designated
 4    teaching nursing homes and affiliated assisted living
      facilities to demonstrate financial responsibility
 5    through an escrow account or letter of credit in lieu of
      professional liability insurance coverage.
