1 A bill to be entitled
2 An act relating to the Sanford Airport
3 Authority, Seminole County; amending chapter
4 71-924, Laws of Florida; authorizing the
5 authority to enter into contracts, leases,
6 franchises, or other arrangements with any
7 person or persons granting the privilege of
8 using or improving any project of the
9 authority, or any portion thereof of space
10 therein, for commercial purposes; providing
11 requirements and limitations with respect
12 thereto; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Subsection (4) of section 11 of chapter
17 71-924, Laws of Florida, is amended to read:
18 Section 11. Powers.--The Sanford Airport Authority
19 shall have the following powers:
20 (4) To acquire property, real and personal, for the
21 purpose of establishing, constructing, enlarging, managing,
22 and operating airports, runways, navigational facilities,
23 buildings, structures, industrial parks, passenger terminals,
24 fuel storage facilities, roadways, taxiways, utility systems,
25 and all other facilities and improvements necessary or
26 desirable for the servicing of aircraft, the comfort and
27 accommodation of air travelers, and the operation of said
28 airport facilities for both foreign and domestic air
29 transportation.
30 (a) The authority may acquire by the power of eminent
31 domain land and the improvements thereon only for public

1 airport purposes in the manner provided by chapters 73 and 74,
2 Florida Statutes, and other applicable laws. In addition to
3 acquiring land for airport purposes by eminent domain, the
4 authority may also acquire land and other property for airport
5 purposes by grant, donation, purchase, or lease in the manner
6 otherwise provided in this act for other projects.
7 (b) The authority may establish such rates, charges,
8 and user fees for use of airports and airport facilities as
9 the authority deems necessary.
10 (c) The authority may also construct or provide for
11 the construction of such special purpose facilities as are
12 usually provided for the repair and servicing of aircraft and
13 for the comfort and convenience of the public, including but
14 not limited to fueling equipment and storage, concessions,
15 restaurants, food and beverage facilities, hotels and other
16 lodging facilities, parking lots, and similar facilities. The
17 authority may lease or sell such special purpose facilities to
18 provide operators or concessionaires or such facilities may be
19 operated by the authority in its discretion.
20 (d) In the operation and management of the airports,
21 the authority may employ such managers, supervisors,
22 technicians, and other personnel as may be necessary for the
23 economical and efficient management thereof, and shall have
24 the power to adopt rules and regulations with reference to all
25 projects and matters under its control. All rules and
26 regulations of the authority shall be a matter of public
27 record, and copies thereof shall be dispensed by the authority
28 at cost to all applicants therefor.
29 (e) In acquiring property from the City of Sanford or
30 from any public agency for airport purposes or in the
31 operation of any airport, the authority shall have full power

1 to contract with the Federal Aviation Authority or any federal
2 agency exercising any function with respect to aviation, air
3 navigation, or air transportation, and the authority shall
4 have full power to abide by all rules and regulations of such
5 federal agencies including the uses to which land may be put
6 and the operation of airports, air navigation facilities, and
7 aircraft. The authority shall further have power to assume any
8 obligations, covenants, or agreements heretofore imposed by
9 any governmental agency by deed, deed restriction or contract
10 on the City of Sanford, or any other governmental agency
11 therein with respect to airports or aviation.
12 (f) The authority in the acquisition, financing and
13 operation of airports and air navigation facilities may
14 exercise the authority and powers provided for cities,
15 counties, villages, or towns of Florida by chapter 332,
16 Florida Statutes, known as the Airport Law of 1945.
17 (g) The authority may advertise and publicize the use
18 of any airport operated by it and may expend its funds for
19 such purposes.
20 (h) The authority shall have full power to finance or
21 refinance the acquisition or construction of airport projects
22 by issuing its revenue bonds or other debt obligations in the
23 manner provided by chapter 332, Florida Statutes, known as the
24 Airport Law of 1945, or as provided by any other applicable
25 general law.
26 (i) The authority may enter into exclusive or
27 nonexclusive contracts, leases, franchises, or other
28 arrangements with any person or persons for terms not
29 exceeding 50 years, granting the privilege of using or
30 improving any project of the authority, or any portion thereof
31 of space therein, for commercial purposes; conferring the

1 privilege of supplying goods, commodities, things, and
2 services or facilities at such project or projects; making
3 available services to be furnished by the authority or its
4 agents at such project; and establishing the terms and
5 conditions and fixing the charges, rentals, or fees for such
6 privileges or services so long as such fees or charges shall
7 not conflict with any applicable rules and regulations of the
8 Public Service Commission.
9 Section 2. This act shall take effect upon becoming a
10 law.
