1 A bill to be entitled
2 An act relating to Hillsborough County;
3 authorizing the Division of Alcoholic Beverages
4 and Tobacco of the Florida Department of
5 Business and Professional Regulation to issue
6 an alcoholic beverage license to the Arts
7 Council of Hillsborough County for use within
8 the Tampa Theatre; providing that the license
9 may be used for special events only; providing
10 for payment of the license fee by the council;
11 providing for sale of beverages for consumption
12 within the theatre; prohibiting sales for
13 consumption off the premises; providing that
14 purchasers may remove partially consumed, open
15 containers from the premises; providing for
16 temporary transfer of the license; providing an
17 effective date.

19 Be It Enacted by the Legislature of the State of Florida:

21 Section 1. Notwithstanding any other provision of law,
22 the Division of Alcoholic Beverages and Tobacco of the Florida
23 Department of Business and Professional Regulation is
24 authorized, upon application, to issue an alcoholic beverage
25 license in accordance with section 561.17, Florida Statutes,
26 to the Arts Council of Hillsborough County, hereinafter
27 referred to as "the council," an independent district in
28 Hillsborough County located at 1000 N. Ashley Street, Suite
29 105, Tampa, for use by the council within the building known
30 as the Tampa Theatre, hereinafter referred to as "the
31 theatre," located at 711 North Franklin Street, Tampa. The

1 council shall pay the applicable license fee provided in
2 section 565.02, Florida Statutes. The license may be used for
3 special events only.
4 Section 2. Alcoholic beverages may be sold by the
5 licensee for consumption within the theatre. The license
6 issued pursuant to this act shall not permit the sale of
7 alcoholic beverages in sealed containers for consumption
8 outside the building. Nothing in this act shall prevent a
9 purchaser of such alcoholic beverages from removing an opened,
10 partially consumed container of alcoholic beverages from the
11 premises of the theatre.
12 Section 3. The council may transfer the license from
13 time to time to qualified applicants who are either authorized
14 by or under contract with the council to provide food services
15 at the theatre. Upon termination of a transferee's
16 authorization or contract, the license automatically reverts
17 by operation of law to the council.
18 Section 4. This act shall take effect upon becoming a
19 law.
