1 A bill to be entitled
2 An act relating to Hillsborough County;
3 providing for a fee to be paid by felony
4 offenders in the county; providing for an
5 accounting of such fees and remission of the
6 fee revenues collected by the Department of
7 Corrections; providing the duties of the clerk
8 of the court in connection with the fee
9 revenues remitted; providing for the use of the
10 funds by the board of county commissioners;
11 providing for costs of administration;
12 providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. (1) Each felony offender assessed in
17 Hillsborough County for supervision costs that are not
18 exempted by the Department of Corrections shall simultaneously
19 pay a separate and additional $5-per-month fee to the
20 Department of Corrections.
21 (2) The department shall remit on a quarterly basis to
22 the Hillsborough County Clerk of the Circuit Court, as ex
23 officio custodian of the funds of the county, such funds
24 collected, less the costs of administration. The department
25 shall collect and maintain an accounting of any fees assessed,
26 fees paid by the offender, the cost of administration, and the
27 amount remitted to the clerk and shall report the accounting
28 to the clerk.
29 (3) The clerk shall maintain such funds in a separate
30 account, invest the funds pursuant to general law, and
31 disburse the funds at the direction of the board of county

1 commissioners, less the costs of administration. The board may
2 appropriate the funds only to offset the costs of housing
3 state inmates in county jail facilities. The clerk shall
4 prepare an audit of the account annually and submit it to the
5 board.
6 (4) The amount deducted for the costs of
7 administration by the clerk may not exceed 3 percent of the
8 total revenue generated by the fee and may be used only for
9 costs that are directly attributable to the fee.
10 Section 2. This act shall take effect October 1, 2005.

15 The committee substitute removes the provision notwithstanding
any other law and the reference to section 948.09(1)(a)1.
