  1                    Senate Resolution No. ____

  2         A resolution relating to State Senator M. Mandy

  3         Dawson, of the 29th Senate District of the

  4         State of Florida.

  5  

  6         WHEREAS, in absence of a sworn complaint, on March 11,

  7  2005, the President of the Senate directed Senate Counsel to

  8  conduct an investigation and to assemble the facts with which

  9  the Senate could determine whether State Senator M. Mandy

10  Dawson had violated certain laws and Senate Rules relating to

11  conduct and ethics, and

12         WHEREAS, that report was submitted to the Senate

13  President on April 11, 2005, and

14         WHEREAS, that written report was forwarded to the

15  Chairman of the Committee on Rules and Calendar for his

16  recommendations as to further handling, and

17         WHEREAS, the Chairman of the Committee on Rules and

18  Calendar has made and communicated his determination that

19  between December 3, 2004, and February 6, 2005, State Senator

20  M. Mandy Dawson violated subsections (3) and (4) of section

21  112.3148, Florida Statutes, and Senate Rule 1.35, and

22         WHEREAS, State Senator M. Mandy Dawson has waived her

23  right to a hearing before the Committee on Rules and Calendar,

24  has consented to the handling of this matter directly by the

25  Senate without a sworn complaint, and has consented to the

26  imposition of discipline by the full Senate, without further

27  notice or hearing, and

28         WHEREAS, the Chairman of the Committee on Rules and

29  Calendar has moved that the applicable Rules of the Senate be

30  waived to allow the Senate to proceed forthwith, in absence of

 1  a sworn complaint, and in absence of a full hearing before any

 2  Committee of the Senate, NOW, THEREFORE,

 3  

 4  Be It Resolved by the Senate of the State of Florida:

 5  

 6         That M. Mandy Dawson, Senator, District 29, did,

 7  between December 3, 2004, and February 6, 2005, violate

 8  subsections (3) and (4) of section 112.3148, Florida Statutes,

 9  and Senate Rule 1.35, and

10         That Senator M. Mandy Dawson is hereby reprimanded for

11  those violations, and

12         That Senator M. Mandy Dawson is hereby removed from the

13  Senate Committee on Ethics and Elections effective immediately

14  and continuing until the 2006 organization session of the

15  Florida Legislature.
