  1                      A bill to be entitled

  2         An act relating to notaries public; amending s.

  3         117.05, F.S.; authorizing notaries to charge

  4         fees per notarized signature; prohibiting

  5         notaries from charging specified persons for

  6         acts relating to application for a benefit

  7         resulting from public service; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Subsection (2) of section 117.05, Florida

13  Statutes, is amended to read:

14         117.05  Use of notary commission; unlawful use; notary

15  fee; seal; duties; employer liability; name change;

16  advertising; photocopies; penalties.--

17         (2)(a)  The fee of a notary public may not exceed $10

18  per signature notarized, not including witness signatures, for

19  any one notarial act, except as provided in s. 117.045.

20         (b)  A notary public may not charge a fee for

21  witnessing an absentee ballot in an election, and must witness

22  such a ballot upon the request of an elector, provided the

23  notarial act is in accordance with the provisions of this

24  chapter.

25         (c)  A notary public may not charge a fee for any

26  notarial act performed for a United States military veteran or

27  a firefighter or law enforcement officer applying for a

28  pension, allotment, allowance, compensation, insurance policy,

29  or other benefit resulting from public service.

30         Section 2.  This act shall take effect January 1, 2006.
