7An act relating to traffic law enforcement; designating
8the Dori Slosberg Safety Belt Law; amending s. 316.614,
9F.S.; requiring law enforcement agencies to adopt policies
10prohibiting racial profiling; requiring law enforcement
11officers to collect certain information to be forwarded by
12the agency to the Department of Highway Safety and Motor
13Vehicles; requiring the department to compile such
14information and annually submit reports of such data to
15the Governor and the Legislature; deleting requirement for
16enforcement of the Florida Safety Belt Law as a secondary
17action; providing an effective date.

19Be It Enacted by the Legislature of the State of Florida:
20
21     Section 1.  This act may be cited as the "Dori Slosberg
22Safety Belt Law."
23     Section 2.  Subsection (8) of section 316.614, Florida
24Statutes, is amended to read:
25     316.614  Safety belt usage.--
26     (8)  Any person who violates the provisions of this section
27commits a nonmoving violation, punishable as provided in chapter
28318. By January 1, 2006, each law enforcement agency in this
29state shall adopt departmental policy to prohibit the practice
30of racial profiling. When a law enforcement officer issues a
31citation for a violation of this section, the law enforcement
32officer must record the race and ethnicity of the violator. All
33law enforcement agencies must maintain such information and
34forward the information to the department in a form and manner
35determined by the department. The department shall collect this
36information by jurisdiction and annually report the data to the
37Governor, the President of the Senate, and the Speaker of the
38House of Representatives. The report must show separate
39statewide totals for the state's county sheriffs and municipal
40law enforcement agencies, state law enforcement agencies, and
41state university law enforcement agencies. However, except for
42violations of s. 316.613, enforcement of this section by state
43or local law enforcement agencies must be accomplished only as a
44secondary action when a driver of a motor vehicle has been
45detained for a suspected violation of another section of this
46chapter, chapter 320, or chapter 322.
47     Section 3.  This act shall take effect upon becoming a law.
