| 4 | advanced registered nurse practitioners to conduct  | 
| 5 | physical examinations of Class "G" permit applicants;  | 
| 6 | amending s. 633.34, F.S.; authorizing physician assistants  | 
| 7 | or advanced registered nurse practitioners to conduct  | 
| 8 | physical examinations of any person applying for  | 
| 9 | employment as a firefighter; providing an effective date. | 
| 10 |

| 11 | Be It Enacted by the Legislature of the State of Florida: | 
| 12 | 
  | 
| 13 |      Section 1.  Subsection (2) of section 493.6108, Florida  | 
| 14 | Statutes, is amended to read: | 
| 15 |      493.6108  Investigation of applicants by Department of  | 
| 16 | Agriculture and Consumer Services.-- | 
| 17 |      (2)  In addition to subsection (1), the department shall  | 
| 18 | make an investigation of the general physical fitness of the  | 
| 19 | Class "G" applicant to bear a weapon or firearm. Determination  | 
| 20 | of physical fitness shall be certified by a physician or  | 
| 21 | physician assistant currently licensed pursuant to chapter 458,  | 
| 22 | chapter 459, or any similar law of another state or authorized  | 
| 23 | to act as a licensed physician by a federal agency or department  | 
| 24 | or by an advanced registered nurse practitioner currently  | 
| 25 | licensed pursuant to chapter 464. Such certification shall be  | 
| 26 | submitted on a form provided by the department. | 
| 27 |      Section 2.  Subsection (5) of section 633.34, Florida  | 
| 28 | Statutes, is amended to read: | 
| 29 |      633.34  Firefighters; qualifications for employment.--Any  | 
| 30 | person applying for employment as a firefighter must: | 
| 31 |      (5)  Be in good physical condition as determined by a  | 
| 32 | medical examination given by a physician, or surgeon, or  | 
| 33 | physician assistant licensed to practice in the state pursuant  | 
| 34 | to chapter 458;, or an osteopathic physician, or surgeon, or  | 
| 35 | physician assistant licensed to practice in the state pursuant  | 
| 36 | to chapter 459; or an advanced registered nurse practitioner  | 
| 37 | licensed to practice in the state pursuant to chapter 464. Such  | 
| 38 | examination may include, but need not be limited to, provisions  | 
| 39 | of the National Fire Protection Association Standard 1582. A  | 
| 40 | medical examination evidencing good physical condition shall be  | 
| 41 | submitted to the division, on a form as provided by rule, before  | 
| 42 | an individual is eligible for admission into a firefighter  | 
| 43 | training program as defined in s. 633.35. | 
| 44 |      Section 3.  This act shall take effect July 1, 2005. |
