A bill to be entitled
2An act relating to physical examinations; amending s.
3493.6108, F.S.; authorizing physician assistants or
4advanced registered nurse practitioners to conduct
5physical examinations of Class "G" permit applicants;
6amending s. 633.34, F.S.; authorizing physician assistants
7or advanced registered nurse practitioners to conduct
8physical examinations of any person applying for
9employment as a firefighter; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Subsection (2) of section 493.6108, Florida
14Statutes, is amended to read:
15     493.6108  Investigation of applicants by Department of
16Agriculture and Consumer Services.--
17     (2)  In addition to subsection (1), the department shall
18make an investigation of the general physical fitness of the
19Class "G" applicant to bear a weapon or firearm. Determination
20of physical fitness shall be certified by a physician or
21physician assistant currently licensed pursuant to chapter 458,
22chapter 459, or any similar law of another state or authorized
23to act as a licensed physician by a federal agency or department
24or by an advanced registered nurse practitioner currently
25licensed pursuant to chapter 464. Such certification shall be
26submitted on a form provided by the department.
27     Section 2.  Subsection (5) of section 633.34, Florida
28Statutes, is amended to read:
29     633.34  Firefighters; qualifications for employment.--Any
30person applying for employment as a firefighter must:
31     (5)  Be in good physical condition as determined by a
32medical examination given by a physician, or surgeon, or
33physician assistant licensed to practice in the state pursuant
34to chapter 458;, or an osteopathic physician, or surgeon, or
35physician assistant licensed to practice in the state pursuant
36to chapter 459; or an advanced registered nurse practitioner
37licensed to practice in the state pursuant to chapter 464. Such
38examination may include, but need not be limited to, provisions
39of the National Fire Protection Association Standard 1582. A
40medical examination evidencing good physical condition shall be
41submitted to the division, on a form as provided by rule, before
42an individual is eligible for admission into a firefighter
43training program as defined in s. 633.35.
44     Section 3.  This act shall take effect July 1, 2005.
