11  Senator Dockery moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 6, lines 1 through 2.., delete those lines
15  
16  and insert:
17         Section 3.  Paragraph (a) of subsection (1) of section
18  287.0595, Florida Statutes, is amended to read:
19         287.0595  Pollution response action contracts;
20  department rules.--
21         (1)  The Department of Environmental Protection shall
22  establish, by adopting administrative rules as provided in
23  chapter 120:
24         (a)  Procedures for determining the qualifications of
25  responsible potential vendors prior to advertisement for and
26  receipt of bids, proposals, or replies for pollution response
27  action contracts, including procedures for the rejection of
28  unqualified vendors. Response actions are those activities
29  described in s. 376.301(39)(37).
30         Section 4.  Paragraph (f) of subsection (2) of section
31  316.302, Florida Statutes, is amended to read:

Florida Senate - 2005 SENATOR AMENDMENT Bill No. CS for CS for SB 330 Barcode 702374 1 316.302 Commercial motor vehicles; safety regulations; 2 transporters and shippers of hazardous materials; 3 enforcement.-- 4 (2) 5 (f) A person who operates a commercial motor vehicle 6 having a declared gross vehicle weight of less than 26,000 7 pounds solely in intrastate commerce and who is not 8 transporting hazardous materials in amounts that require 9 placarding pursuant to 49 C.F.R. part 172, or who is 10 transporting petroleum products as defined in s. 376.301(31), 11 is exempt from subsection (1). However, such person must 12 comply with 49 C.F.R. parts 382, 392, and 393, and with 49 13 C.F.R. ss. 396.3(a)(1) and 396.9. 14 Section 5.
