11  Senator Argenziano moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 1, line 27, through
15            page 2, line 1, delete those lines
16  
17  and insert:  performances during either of the 2 preceding
18  years; for a jai alai permitholder that does not operate slot
19  machines in its pari-mutuel facility, that has conducted at
20  least 100 live performances per year for at least 10 years
21  after December 31, 1992, and whose handle on live jai alai
22  games conducted at its pari-mutuel facility has been less than
23  $4 million per state fiscal year for at least 2 consecutive
24  years after June 30, 1992, the conduct of a combination of at
25  least 40 live evening or matinee performances during the
26  preceding year; for a jai alai permitholder that operates slot
27  machines in its pari-mutuel facility, the conduct of a
28  combination of at least 150 performances during the preceding
29  year; for a harness permitholder, the conduct of at
