20 | Be It Enacted by the Legislature of the State of Florida: |
21 |
|
22 | Section 1. Subsections (1) and (4) of section 943.61, |
23 | Florida Statutes, are amended to read: |
24 | 943.61 Powers and duties of the Capitol Police.-- |
25 | (1) There is created the Capitol Police within the |
26 | Department of Law Enforcement, to serve the safety and security |
27 | needs of both the legislative and executive branches of state |
28 | government. It is the intent of the Legislature that the Capitol |
29 | Police serve as a specially trained and highly effective |
30 | security and law enforcement agency serving the Capitol Complex |
31 | and the state. It shall be the primary responsibility of the |
32 | Capitol Police to protect the security of the Governor, the |
33 | Lieutenant Governor, the members of the Cabinet, and the members |
34 | of the Senate and of the House of Representatives, and those |
35 | employees assigned to assist such state officials in the |
36 | performance of their official duties, and to ensure their access |
37 | to buildings and premises within the Capitol Complex, thereby |
38 | providing for the continuous operation of the government of the |
39 | State of Florida. The provision of other law enforcement |
40 | services and protection of property shall be secondary |
41 | responsibilities. |
42 | (4) The Capitol Police shall have the following |
43 | responsibilities, powers, and duties: |
44 | (a) To develop, in consultation with the Governor, Cabinet |
45 | officers, the President of the Senate, and the Speaker of the |
46 | House of Representatives, written operational plans for basic |
47 | and enhanced security measures and actions related to the |
48 | Capitol Complex. Such plans and any changes or amendments |
49 | thereto shall not be implemented unless presented in writing in |
50 | final form to the Governor, the President of the Senate, and the |
51 | Speaker of the House of Representatives and all three grant |
52 | their approval in writing. The approval of any officer required |
53 | herein shall expire 60 days after such officer vacates his or |
54 | her office, and the written approval of the successor in office |
55 | must be obtained prior to the continuation of operations under |
56 | such plans. Upon the request of the Governor, a Cabinet officer, |
57 | the President of the Senate, or the Speaker of the House of |
58 | Representatives, the Capitol Police shall activate previously |
59 | approved enhanced security measures and actions in accordance |
60 | with the approved operational plans specific to the requesting |
61 | officer's responsibilities and to the facilities occupied by |
62 | such officer and employees responsible to such officer. Upon an |
63 | emergency threatening the immediate safety and security of |
64 | occupants of the Capitol Complex, so declared by the Governor, |
65 | plans not approved as required by this paragraph may be |
66 | implemented for a period not to exceed 15 days, provided such |
67 | plans do not substantially interfere with the ability of the |
68 | Senate and the House of Representatives to assemble for any |
69 | constitutional purpose. |
70 | (b) To provide and maintain the security of all property |
71 | located in the Capitol Complex in a manner consistent with the |
72 | security plans developed and approved under paragraph (a) and, |
73 | in consultation with the State Fire Marshal, to provide for |
74 | evacuations, information, and training required for firesafety |
75 | on such property in a manner consistent with s. 633.085. |
76 | (c) To develop plans for reporting incidents involving |
77 | buildings and property within the Capitol Complex, emergency |
78 | procedures and evacuation routes in the event of fire, security |
79 | threats, incidents prompting a need for evacuation, acts of |
80 | terrorism, or natural or manmade disaster and to make such |
81 | procedures and routes known to those persons occupying such |
82 | buildings. |
83 | (d) To employ officers who hold certification as law |
84 | enforcement officers in accordance with the minimum standards |
85 | and qualifications as set forth in s. 943.13 and the provisions |
86 | of chapter 110, and who have the authority to bear arms, make |
87 | arrests, except as may be limited in the security plans |
88 | established under paragraph (a), and apply for arrest warrants. |
89 | (e) To hire guards and administrative, clerical, |
90 | technical, and other personnel as may be required. |
91 | (f) To train all officers and other employees in fire |
92 | prevention, firesafety, emergency medical procedures, and |
93 | preventing and responding to acts of terrorism. |
94 | (g) To respond to all complaints relating to criminal |
95 | activity or security threats within the Capitol Complex, or |
96 | against the Governor, the Lieutenant Governor, a member of the |
97 | Cabinet, a member of the Senate or of the House of |
98 | Representatives, or an employee assisting such official. |
99 | (h) As provided by the security plans developed and |
100 | approved under paragraph (a), upon request of the presiding |
101 | officer of either house of the Legislature, the director may |
102 | assign one or more officers for the protection of a member of |
103 | the house served by such presiding officer. Per diem and |
104 | subsistence allowance for department employees traveling with a |
105 | member of the Legislature away from Tallahassee shall be |
106 | computed by payment of a sum up to the amounts permitted in s. |
107 | 112.061 for meals, plus actual expenses for lodging to be |
108 | substantiated by paid bills therefor. |
109 | (i) To enforce rules of the Department of Management |
110 | Services governing the regulation of traffic and parking within |
111 | the Capitol Complex and to impound illegally or wrongfully |
112 | parked vehicles. |
113 | (j) To establish policies for the organizational |
114 | structure, principles of command, and internal operations of the |
115 | Capitol Police, provided that such policies are not inconsistent |
116 | with the provisions of ss. 943.61-943.68 or the security plans |
117 | developed and approved under paragraph (a). |
118 | (k) To carry out the transportation and protective |
119 | services functions described in s. 943.68. |
120 | Section 2. Subsection (6) is added to section 943.611, |
121 | Florida Statutes, to read: |
122 | 943.611 Director of Capitol Police.-- |
123 | (6) At the discretion of the executive director of the |
124 | department, the director may serve as the director of the unit |
125 | within the department providing transportation and protective |
126 | services as set forth in s. 943.68. |
127 | Section 3. Subsection (1) of section 943.62, Florida |
128 | Statutes, is amended to read: |
129 | 943.62 Investigations by the Capitol Police.-- |
130 | (1) In addition to, and in conjunction with, the other |
131 | powers and duties specified by law, the Capitol Police shall |
132 | conduct traffic accident investigations and investigations |
133 | relating to felonies and misdemeanors occurring within the |
134 | Capitol Complex. Any matters may be referred to the department's |
135 | special agents or inspectors or another appropriate law |
136 | enforcement agency for further investigation. Such referrals |
137 | shall include transmittal of records, reports, statements, and |
138 | all other information relating to such matters. |
139 | Section 4. Section 943.64, Florida Statutes, is amended to |
140 | read: |
141 | 943.64 Ex officio agents.--Law enforcement officers of the |
142 | Department of Highway Safety and Motor Vehicles, special agents |
143 | or inspectors of the Department of Law Enforcement, and law |
144 | enforcement officers of other state agencies, counties, and |
145 | municipalities are ex officio agents of the Capitol Police, and |
146 | may, when authorized by the executive director of the department |
147 | or the executive director's designee Capitol Police, enforce |
148 | rules and laws applicable to the powers and duties of the |
149 | Capitol Police to provide and maintain the security required by |
150 | ss. 943.61-943.68. |
151 | Section 5. Subsections (3), (6), and (9) of section |
152 | 943.68, Florida Statutes, are amended to read: |
153 | 943.68 Transportation and protective services.-- |
154 | (3) The executive director shall assign agents for the |
155 | performance of the duties prescribed in this section. The |
156 | assignment of such agents shall be subject to continuing |
157 | approval of the Governor. Upon request of the Governor, the |
158 | executive director shall reassign an agent from continued |
159 | performance of such duties. The executive director may authorize |
160 | the Director of Capitol Police to exercise the authority |
161 | provided in this subsection. |
162 | (6) The department shall provide security or |
163 | transportation services to other persons when requested by the |
164 | Governor, the Lieutenant Governor, a member of the Cabinet, the |
165 | Speaker of the House of Representatives, the President of the |
166 | Senate, or the Chief Justice of the Supreme Court, subject to |
167 | certification by the requesting party agency head that such |
168 | services are in the best interest of the state. The requesting |
169 | party agency head may delegate certification authority to the |
170 | executive director of the department. The requesting party |
171 | agency head shall limit such services to persons: |
172 | (a) Who are visiting the state; for whom such services are |
173 | requested by the Governor, the Lieutenant Governor, a member of |
174 | the Cabinet, the Speaker of the House of Representatives, the |
175 | President of the Senate, or the Chief Justice of the Supreme |
176 | Court; and for whom the primary purpose of the visit is for a |
177 | significant public purpose and to promote the development of the |
178 | state; or |
179 | (b) For whom the failure to provide security or |
180 | transportation could result in a clear and present danger to the |
181 | personal safety of such persons or to the safety of other |
182 | persons or property within this state or could result in public |
183 | embarrassment to the state. |
184 | (9) The department shall submit a report each reports on |
185 | July 15 and January 15 of each year to the President of the |
186 | Senate, Speaker of the House of Representatives, Governor, and |
187 | members of the Cabinet, detailing all transportation and |
188 | protective services provided under subsections (1), (5), and (6) |
189 | within the preceding fiscal year 6 months. Each report shall |
190 | include a detailed accounting of the cost of such transportation |
191 | and protective services, including the names of persons provided |
192 | such services and the nature of state business performed. |
193 | Section 6. Paragraph (a) of subsection (1) of section |
194 | 316.640, Florida Statutes, is amended to read: |
195 | 316.640 Enforcement.--The enforcement of the traffic laws |
196 | of this state is vested as follows: |
197 | (1) STATE.-- |
198 | (a)1.a. The Division of Florida Highway Patrol of the |
199 | Department of Highway Safety and Motor Vehicles;, the Division |
200 | of Law Enforcement of the Fish and Wildlife Conservation |
201 | Commission;, the Division of Law Enforcement of the Department |
202 | of Environmental Protection;, and law enforcement officers of |
203 | the Department of Transportation; and the agents, inspectors, |
204 | and officers of the Department of Law Enforcement each have |
205 | authority to enforce all of the traffic laws of this state on |
206 | all the streets and highways thereof and elsewhere throughout |
207 | the state wherever the public has a right to travel by motor |
208 | vehicle. |
209 | b. University police officers shall have authority to |
210 | enforce all of the traffic laws of this state when such |
211 | violations occur on or about any property or facilities that are |
212 | under the guidance, supervision, regulation, or control of a |
213 | state university, a direct-support organization of such state |
214 | university, or any other organization controlled by the state |
215 | university or a direct-support organization of the state |
216 | university, except that traffic laws may be enforced off-campus |
217 | when hot pursuit originates on or adjacent to any such property |
218 | or facilities. |
219 | c. Community college police officers shall have the |
220 | authority to enforce all the traffic laws of this state only |
221 | when such violations occur on any property or facilities that |
222 | are under the guidance, supervision, regulation, or control of |
223 | the community college system. |
224 | d. Police officers employed by an airport authority shall |
225 | have the authority to enforce all of the traffic laws of this |
226 | state only when such violations occur on any property or |
227 | facilities that are owned or operated by an airport authority. |
228 | (I) An airport authority may employ as a parking |
229 | enforcement specialist any individual who successfully completes |
230 | a training program established and approved by the Criminal |
231 | Justice Standards and Training Commission for parking |
232 | enforcement specialists but who does not otherwise meet the |
233 | uniform minimum standards established by the commission for law |
234 | enforcement officers or auxiliary or part-time officers under s. |
235 | 943.12. Nothing in this sub-sub-subparagraph shall be construed |
236 | to permit the carrying of firearms or other weapons, nor shall |
237 | such parking enforcement specialist have arrest authority. |
238 | (II) A parking enforcement specialist employed by an |
239 | airport authority is authorized to enforce all state, county, |
240 | and municipal laws and ordinances governing parking only when |
241 | such violations are on property or facilities owned or operated |
242 | by the airport authority employing the specialist, by |
243 | appropriate state, county, or municipal traffic citation. |
244 | e. The Office of Agricultural Law Enforcement of the |
245 | Department of Agriculture and Consumer Services shall have the |
246 | authority to enforce traffic laws of this state. |
247 | f. School safety officers shall have the authority to |
248 | enforce all of the traffic laws of this state when such |
249 | violations occur on or about any property or facilities which |
250 | are under the guidance, supervision, regulation, or control of |
251 | the district school board. |
252 | 2. An agency of the state as described in subparagraph 1. |
253 | is prohibited from establishing a traffic citation quota. A |
254 | violation of this subparagraph is not subject to the penalties |
255 | provided in chapter 318. |
256 | 3. Any disciplinary action taken or performance evaluation |
257 | conducted by an agency of the state as described in subparagraph |
258 | 1. of a law enforcement officer's traffic enforcement activity |
259 | must be in accordance with written work-performance standards. |
260 | Such standards must be approved by the agency and any collective |
261 | bargaining unit representing such law enforcement officer. A |
262 | violation of this subparagraph is not subject to the penalties |
263 | provided in chapter 318. |
264 | 4. The Division of the Florida Highway Patrol may employ |
265 | as a traffic accident investigation officer any individual who |
266 | successfully completes instruction in traffic accident |
267 | investigation and court presentation through the Selective |
268 | Traffic Enforcement Program as approved by the Criminal Justice |
269 | Standards and Training Commission and funded through the |
270 | National Highway Traffic Safety Administration or a similar |
271 | program approved by the commission, but who does not necessarily |
272 | meet the uniform minimum standards established by the commission |
273 | for law enforcement officers or auxiliary law enforcement |
274 | officers under chapter 943. Any such traffic accident |
275 | investigation officer who makes an investigation at the scene of |
276 | a traffic accident may issue traffic citations, based upon |
277 | personal investigation, when he or she has reasonable and |
278 | probable grounds to believe that a person who was involved in |
279 | the accident committed an offense under this chapter, chapter |
280 | 319, chapter 320, or chapter 322 in connection with the |
281 | accident. This subparagraph does not permit the officer to carry |
282 | firearms or other weapons, and such an officer does not have |
283 | authority to make arrests. |
284 | Section 7. This act shall take effect July 1, 2005. |
