11  Senator Bennett moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 8, line 29, through page 10, line 2, delete
15  those lines
16  
17  and insert:  
18         (b)  The capital improvements element shall be reviewed
19  on an annual basis and modified as necessary in accordance
20  with s. 163.3187 or s. 163.3189 in order to maintain a
21  financially feasible 5-year schedule of capital improvements.,
22  except that Corrections, updates, and modifications concerning
23  costs; revenue sources; or acceptance of facilities pursuant
24  to dedications which are consistent with the plan; or the date
25  of construction of any facility enumerated in the capital
26  improvements element may be accomplished by ordinance and
27  shall not be deemed to be amendments to the local
28  comprehensive plan. A copy of the ordinance shall be
29  transmitted to the state land planning agency. An amendment to
30  the comprehensive plan is required to update the schedule on
31  an annual basis or to eliminate, defer, or delay the

 1  construction for any facility listed in the 5-year schedule.
 2  All public facilities shall be consistent with the capital
 3  improvements element. Amendments to implement this section
 4  must be adopted and transmitted no later than December 1,
 5  2007. Thereafter, a local government may not amend its future
 6  land use map, except for plan amendments to meet new
 7  requirements under this part and emergency amendments pursuant
 8  to s. 163.3187(1)(a), after December 1, 2007, and every year
 9  thereafter, unless and until the local government has adopted
10  the annual update and it has been transmitted to the state
11  land planning agency.
