8 | creating s. 381.0043, F.S.; providing a popular name; |
9 | providing that no blood bank or subsidiary or affiliate |
10 | thereof or employee or agent of a blood bank or subsidiary |
11 | or affiliate thereof may be compelled to disclose the |
12 | identity or identifying characteristics of any person who |
13 | donates blood or any blood components; providing an |
14 | exception; providing an effective date. |

16 | Be It Enacted by the Legislature of the State of Florida: |

18 | Section 1. Section 381.0043, Florida Statutes, is created |
19 | to read: |
20 | 381.0043 Blood Donor Protection Act; blood and blood |
21 | component donors; confidentiality.-- |
22 | (1) This section may be cited as the "Blood Donor |
23 | Protection Act." |
24 | (2) No blood bank or subsidiary or affiliate thereof or |
25 | employee or agent of a blood bank or subsidiary or affiliate |
26 | thereof may be compelled to disclose the identity or identifying |
27 | characteristics of any person who donates blood or any blood |
28 | components. This subsection shall not apply if written consent |
29 | to disclose the donor's identity or any identifying |
30 | characteristics is obtained from the individual donating blood |
31 | or blood components and shall not apply to preclude disclosure |
32 | to any local, state, or federal governmental public health |
33 | authority as required by law. |
34 | Section 2. This act shall take effect July 1, 2005. |
