A bill to be entitled
2An act relating to alarm system contracting; amending s.
3633.702, F.S.; providing a criminal penalty for
4intentionally or willfully installing, servicing, testing,
5repairing, improving, or inspecting a fire alarm system
6unless authorized by part II of ch. 489; providing
7exemptions; providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Subsection (4) is added to section 633.702,
12Florida Statutes, to read:
13     633.702  Prohibited acts regarding alarm system contractors
14or certified unlimited electrical contractors; penalties.--
15     (4)  It is a misdemeanor of the first degree, punishable as
16provided in s. 775.082 or s. 775.083, for any person to
17intentionally or willfully install, service, test, repair,
18improve, or inspect a fire alarm system unless:
19     (a)  The person is the holder of a valid and current active
20license as a certified unlimited electrical contractor, as
21defined in part II of chapter 489;
22     (b)  The person is the holder of a valid and current active
23license as a licensed fire alarm contractor, as defined in part
24II of chapter 489;
25     (c)  The person is authorized to act as a fire alarm system
26agent pursuant to s. 489.5185; or
27     (d)  The person is exempt pursuant to s. 489.503.
28     Section 2.  This act shall take effect October 1, 2005.
