14         On page 8, line 3, through
15            page 10, line 5, delete those lines

17  and insert:  
18         Section 1.  Paragraph (a) of subsection (2) and
19  subsections (3) and (4) of section 215.559, Florida Statutes,
20  are amended, present subsection (7) of that section is
21  redesignated as subsection (8) and amended, present
22  subsections (5) and (6) of that section are redesignated as
23  subsections (6) and (7), respectively, and a new subsection
24  (5) is added to that section, to read:
25         215.559  Hurricane Loss Mitigation Program.--
26         (2)(a)  Seven million dollars in funds provided in
27  subsection (1) shall be used for programs to improve the wind
28  resistance of residences and mobile homes, including loans,
29  subsidies, grants, demonstration projects, and direct
30  assistance; educating persons concerning the Florida Building
31  Code cooperative programs with local governments and the

Florida Senate - 2005 SENATOR AMENDMENT Bill No. CS for CS for CS for CS for SB 442 Barcode 145694 1 Federal Government; and other efforts to prevent or reduce 2 losses or reduce the cost of rebuilding after a disaster. 3 (3) Forty percent of the total appropriation in 4 paragraph (2)(a) shall be used to inspect and improve 5 tie-downs for mobile homes. Within 30 days after the effective 6 date of that appropriation, the department shall contract with 7 a public higher educational institution in this state which 8 has previous experience in administering the programs set 9 forth in this subsection to serve as the administrative entity 10 and fiscal agent pursuant to s. 216.346 for the purpose of 11 administering the programs set forth in this subsection in 12 accordance with established policy and procedures. The 13 administrative entity working with the advisory council set up 14 under subsection (5) shall develop a list of mobile home parks 15 and counties that may be eligible to participate in the 16 tie-down program. 17 (4) Of moneys provided to the Department of Community 18 Affairs in paragraph (2)(a), 10 percent shall be allocated to 19 a Type I Center within the State University System dedicated 20 to hurricane research. The Type I Center shall develop a 21 preliminary work plan approved by the advisory council set 22 forth in subsection (6) (5) to eliminate the state and local 23 barriers to upgrading existing mobile homes and communities, 24 research and develop a program for the recycling of existing 25 older mobile homes, and support programs of research and 26 development relating to hurricane loss reduction devices and 27 techniques for site-built residences. The State University 28 System also shall consult with the Department of Community 29 Affairs and assist the department with the report required 30 under subsection (8) (7). 31 (5) An amount equal to fifteen percent of the total 2 12:44 PM 04/29/05 s0442c4c-08-c8y
Florida Senate - 2005 SENATOR AMENDMENT Bill No. CS for CS for CS for CS for SB 442 Barcode 145694 1 appropriation in paragraph (2)(a) shall be used for education 2 awareness concerning the Florida Building Code and the 3 operation of the disaster contractors network. Not more than 4 30 days after the effective date of each subsequent 5 appropriation, the Department of Community Affairs shall 6 contract with a nonprofit tax-exempt entity having prior 7 contracting experience with building code training, 8 development, and coordination and whose membership is 9 representative of all of the statewide construction and design 10 licensee associations. The entity shall allocate 20 percent of 11 these resources to the disaster contractors network for the 12 education of the construction industry and hurricane response 13 if needed to coordinate the industry in the event of a natural 14 disaster. The entity shall allocate 20 percent of these 15 resources to the largest residential construction trade show 16 in the state for the education of the residential construction 17 industry on building code and mitigation issues. The remaining 18 resources shall be used by the entity for outreach building 19 code activities after consultation with the building code 20 program under the Florida Building Commission as provided for 21 in s. 553.841. 22 (8)(7) On January 1st of each year, the Department of 23 Community Affairs shall provide a full report and accounting 24 of activities under this section and an evaluation of such 25 activities to the Speaker of the House of Representatives, the 26 President of the Senate, and the Majority and Minority Leaders 27 of the House of Representatives and the Senate. Upon 28 completion of the report, the Department of Community Affairs 29 shall deliver the report to the Office of Insurance 30 Regulation. These recommendations may be used by 3 insurers for potential discounts or rebates pursuant to s. 4 627.0629.
