15         On page 1, line 18, through
16            page 4, line 5, delete those lines

18  and insert:  
19         Section 1.  Paragraph (a) of subsection (2) and
20  subsections (3), (4), and (7) of section 215.559, Florida
21  Statutes, are amended to read:
22         215.559  Hurricane Loss Mitigation Program.--
23         (2)(a)  Seven million dollars in funds provided in
24  subsection (1) shall be used for programs to improve the wind
25  resistance of residences and mobile homes, including loans,
26  subsidies, grants, demonstration projects, and direct
27  assistance; educating persons concerning the Florida Building
28  Code cooperative programs with local governments and the
29  Federal Government; and other efforts to prevent or reduce
30  losses or reduce the cost of rebuilding after a disaster.
31         (3)  Forty percent of the total appropriation in

Within 30 days after the effective 3 date of that appropriation, the department shall contract with 4 a public higher educational institution in this state which 5 has previous experience in administering the programs set 6 forth in this subsection to serve as the administrative entity 7 and fiscal agent pursuant to s. 216.346 for the purpose of 8 administering the programs set forth in this subsection in 9 accordance with established policy and procedures. The 10 administrative entity working with the advisory council set up 11 under subsection (5) shall develop a list of mobile home parks 12 and counties that may be eligible to participate in the 13 tie-down program. 14 (4) Of moneys provided to the Department of Community 15 Affairs in paragraph (2)(a), 10 percent shall be allocated to 16 a Type I Center within the State University System dedicated 17 to hurricane research. The Type I Center shall develop a 18 preliminary work plan approved by the advisory council set 19 forth in subsection (6) (5) to eliminate the state and local 20 barriers to upgrading existing mobile homes and communities, 21 research and develop a program for the recycling of existing 22 older mobile homes, and support programs of research and 23 development relating to hurricane loss reduction devices and 24 techniques for site-built residences. The State University 25 System also shall consult with the Department of Community 26 Affairs and assist the department with the report required 27 under subsection (8) (7). 28 (7) On January 1st of each year, the Department of 29 Community Affairs shall provide a full report and accounting 30 of activities under this section and an evaluation of such 31 activities to the Speaker of the House of Representatives, the 2 1:45 PM 05/02/05 s0442c4c-22-tp9

Upon 3 completion of the report, the Department of Community Affairs 4 shall deliver the report to the Office of Insurance 5 Regulation. The Office of Insurance Regulation shall review 6 the report and shall make such recommendations available to 7 the insurance industry as the Office of Insurance Regulation 8 determines appropriate. These recommendations may be used by 9 insurers for potential discounts or rebates pursuant to s. 10 627.0629.
