| 3 | amending s. 1008.25, F.S.; requiring the comprehensive |
| 4 | program for student progression to include assessment of |
| 5 | performance in social studies; clarifying participation in |
| 6 | the statewide assessment program; amending ss. 1003.51 and |
| 7 | 1003.52, F.S.; conforming provisions relating to subject |
| 8 | area grade level proficiency of students in Department of |
| 9 | Juvenile Justice education programs; specifying that the |
| 10 | act does not require a change in subject areas measured by |
| 11 | the statewide assessment program; providing an effective |
| 12 | date. |

| 14 | Be It Enacted by the Legislature of the State of Florida: |
| 15 |
|
| 16 | Section 1. Subsection (1), paragraph (b) of subsection |
| 17 | (2), paragraph (a) of subsection (4), and paragraph (a) of |
| 18 | subsection (8) of section 1008.25, Florida Statutes, are amended |
| 19 | to read: |
| 20 | 1008.25 Public school student progression; remedial |
| 21 | instruction; reporting requirements.-- |
| 22 | (1) INTENT.--It is the intent of the Legislature that each |
| 23 | student's progression from one grade to another be determined, |
| 24 | in part, upon proficiency in reading, writing, science, social |
| 25 | studies, and mathematics; that district school board policies |
| 26 | facilitate such proficiency; and that each student and his or |
| 27 | her parent be informed of that student's academic progress. |
| 28 | (2) COMPREHENSIVE PROGRAM.--Each district school board |
| 29 | shall establish a comprehensive program for student progression |
| 30 | which must include: |
| 31 | (b) Specific levels of performance in reading, writing, |
| 32 | science, social studies, and mathematics for each grade level, |
| 33 | including the levels of performance on statewide assessments in |
| 34 | those subject areas for which assessment tests are available and |
| 35 | as defined by the commissioner, below which a student must |
| 36 | receive remediation, or be retained within an intensive program |
| 37 | that is different from the previous year's program and that |
| 38 | takes into account the student's learning style. |
| 39 | (4) ASSESSMENT AND REMEDIATION.-- |
| 40 | (a) Each student must participate in the statewide |
| 41 | assessment tests required by s. 1008.22 in those subject areas |
| 42 | for which assessment tests are available. Each student who does |
| 43 | not meet specific levels of performance as determined by the |
| 44 | district school board in reading, writing, science, social |
| 45 | studies, and mathematics for each grade level, or who does not |
| 46 | meet specific levels of performance as determined by the |
| 47 | commissioner on statewide assessments at selected grade levels, |
| 48 | must be provided with additional diagnostic assessments to |
| 49 | determine the nature of the student's difficulty and areas of |
| 50 | academic need. |
| 51 | (8) ANNUAL REPORT.-- |
| 52 | (a) In addition to the requirements in paragraph (5)(b), |
| 53 | each district school board must annually report to the parent of |
| 54 | each student the progress of the student toward achieving state |
| 55 | and district expectations for proficiency in reading, writing, |
| 56 | science, social studies, and mathematics. The district school |
| 57 | board must report to the parent the student's results on each |
| 58 | statewide assessment test. The evaluation of each student's |
| 59 | progress must be based upon the student's classroom work, |
| 60 | observations, tests, district and state assessments, and other |
| 61 | relevant information. Progress reporting must be provided to the |
| 62 | parent in writing in a format adopted by the district school |
| 63 | board. |
| 64 | Section 2. Paragraph (c) of subsection (3) of section |
| 65 | 1003.51, Florida Statutes, is amended to read: |
| 66 | 1003.51 Other public educational services.-- |
| 67 | (3) The Department of Education in partnership with the |
| 68 | Department of Juvenile Justice, the district school boards, and |
| 69 | providers shall: |
| 70 | (c) Maintain standardized required content of education |
| 71 | records to be included as part of a youth's commitment record. |
| 72 | These requirements shall reflect the policy and standards |
| 73 | adopted pursuant to subsection (2) and shall include, but not be |
| 74 | limited to, the following: |
| 75 | 1. A copy of the student's individual educational plan. |
| 76 | 2. Assessment data, including grade level proficiency in |
| 77 | reading, writing, science, social studies, and mathematics, and |
| 78 | performance on tests taken according to s. 1008.22. |
| 79 | 3. A copy of the student's permanent cumulative record. |
| 80 | 4. A copy of the student's academic transcript. |
| 81 | 5. A portfolio reflecting the youth's academic |
| 82 | accomplishments while in the Department of Juvenile Justice |
| 83 | program. |
| 84 | Section 3. Subsection (7) of section 1003.52, Florida |
| 85 | Statutes, is amended to read: |
| 86 | 1003.52 Educational services in Department of Juvenile |
| 87 | Justice programs.-- |
| 88 | (7) An academic improvement plan shall be developed for |
| 89 | students who score below the level specified in district school |
| 90 | board policy in reading, writing, science, social studies, and |
| 91 | mathematics or below the level specified by the Commissioner of |
| 92 | Education on statewide assessments as required by s. 1008.25. |
| 93 | These plans shall address academic, literacy, and life skills |
| 94 | and shall include provisions for intensive remedial instruction |
| 95 | in the areas of weakness. |
| 96 | Section 4. Nothing in this act shall require a change in |
| 97 | the subject areas measured by the statewide assessment program |
| 98 | pursuant to s. 1008.22, Florida Statutes. |
| 99 | Section 5. This act shall take effect July 1, 2005. |
