11 The Committee on Transportation (Sebesta) recommended the
12 following amendment to amendment (753114):

14 Senate Amendment (with title amendment)
15 On page 11, between lines 16 and 17,
16
17 insert:
18 Section 11. Subsection (14) of section 322.2615,
19 Florida Statutes, is amended, and subsection (16) is added to
20 that section, to read:
21 322.2615 Suspension of license; right to review.--
22 (14)(a) The decision of the department under this
23 section mayshall not be considered in any trial for a
24 violation of s. 316.193, and anor shall any written statement
25 submitted by a person in his or her request for departmental
26 review under this section may not be admittedadmissible into
27 evidence against him or her in any such trial.
28 (b)The disposition of any related criminal proceedings
29 doesshall not affect a suspension for refusal to submit to a
30 blood, breath, or urine test, authorized by s. 316.1932 or s.
31 316.1933,imposed underpursuant to this section.

1 (16) The department shall invalidate a suspension for
2 driving with an unlawful blood-alcohol level or breath-alcohol
3 level imposed under this section if the suspended person is
4 found not guilty at trial of an underlying violation of s.
5 316.193.

11 And the title is amended as follows:
12 On page 15, line 11, after the first semicolon
13
14 insert:
15 amending s. 322.2615, F.S.; providing that the
16 disposition of a related criminal proceeding
17 may not affect a suspension of a driver's
18 license for refusal to submit to blood, breath,
19 or urine testing; directing the Department of
20 Highway Safety and Motor Vehicles to invalidate
21 a suspension for driving with an unlawful
22 blood-alcohol level or breath-alcohol level if
23 the suspended person is found not guilty at
24 trial of the underlying violation of law;
