16 On page 6, lines 1 through 21, delete those lines

18 and insert:
19 Section 14. Section 321.24, Florida Statutes, is
20 amended to read:
21 321.24 Members of an auxiliary to Florida Highway
22 Patrol.--
23 (1) The director of the Florida Highway Patrol is
24 hereby authorized to establish an auxiliary to the Florida
25 Highway Patrol to be composed of such persons who may
26 volunteer to serve as members of an auxiliary to the Florida
27 Highway Patrol. Such service to be without compensation to
28 the individual so volunteering.
29 (2) Members of an auxiliary serving with the Florida
30 Highway Patrol shall at all times serve under the direction
31 and supervision of the director and members of the Florida

1 Highway Patrol. After approval by the director on an
2 individual basis and after completion of a firearms course
3 approved by the director, members of an auxiliary, while
4 serving under the supervision and direction of the director,
5 or a member of the Florida Highway Patrol, shall have the
6 power to bear arms and make arrests. Members of an auxiliary
7 shall have the same protection and immunities afforded
8 regularly employed highway patrol officers, which shall be
9 recognized by all courts having jurisdiction over offenses
10 against the laws of this state.
11 (3) The director of the Florida Highway Patrol shall
12 determine the fitness of persons to serve as members of an
13 auxiliary, shall require their completion of a regularly
14 prescribed course of study for members of an auxiliary as
15 established and conducted by the Florida Highway Patrol. The
16 total number of members of the auxiliary to the Florida
17 Highway Patrol shall be limited to 5 times the total number of
18 regularly employed highway patrol officers authorized by law.
19 (4) No member of the auxiliary shall be required to
20 serve on any duty of and for said auxiliary without his or her
21 consent thereto. The duties of the auxiliary shall be limited
22 to assisting the Florida Highway Patrol in the performance of
23 its regularly constituted duties.
24 (5) Notwithstanding any other law to the contrary,
25 any volunteer highway patrol troop surgeon appointed by the
26 director of the Florida Highway Patrol, and any volunteer
27 licensed health professional appointed by the director of the
28 Florida Highway Patrol to work under the medical direction of
29 a highway patrol troop surgeon are considered employees for
30 purposes of s. 768.28(9).
