14 On page 13, between lines 23 and 24,

16 insert:
17 Section 4. Paragraph (d) is added to subsection (10)
18 of section 334.044, Florida Statutes, to read:
19 334.044 Department; powers and duties.--The department
20 shall have the following general powers and duties:
21 (10)
22 (d)1. In its highway pavement type selection process,
23 the department shall use an analysis period of 40 years for
24 all pavement materials.
25 2. The department's pavement type selection process of
26 a planned project shall include all agency costs and costs to
27 the users of the facility, throughout the analysis period, as
28 recommended by the Federal Highway Administration. Agency
29 costs shall include the cost of contract administration
30 design, all construction items, construction engineering
31 inspection, materials testing, and work zone requirements

1 relating to the maintenance of traffic and safety. User costs
2 shall include motorist delay, vehicle operating, and crash
3 costs.
4 3. Pavement design standards for all lanes on the
5 Florida Interstate Highway system shall stipulate that
6 flexible pavements that are determined to be deficient within
7 10 years of initial construction or from the date of the most
8 recent rehabilitation and that have 12 percent or higher truck
9 traffic, shall be rehabilitated with rigid pavement material.
10 Section 5. Subsections (1), (2), and (3) of section
11 334.045, Florida Statutes, are amended to read:
12 334.045 Transportation performance and productivity
13 standards; development; measurement; application.--
14 (1) The Florida Transportation Commission shall
15 develop and adopt measures for evaluating the performance,
16 cost-effectiveness, and productivity of the department. The
17 measures may be both quantitative and qualitative and must, to
18 the maximum extent practical, assess those factors that are
19 within the department's control. The measures must, at a
20 minimum, assess performance in the following areas:
21 (a) Production;
22 (b) Finance and administration;
23 (c) Preservation of the current state system;
24 (d) Safety of the current state system;
25 (e) Capacity improvements: highways and all public
26 transportation modes; and
27 (f) Disadvantaged business enterprise and minority
28 business programs.
29 (2) The commission shall establish annual performance
30 objectives and standards that can be used to evaluate the
31 department's performance, cost-effectiveness, and

1 productivity.
2 (3) The commission shall evaluate the department's
3 performance, cost-effectiveness, and productivity quarterly,
4 using the measures adopted under this section.
