18 Section 4. Subsection (1) of section 338.155, F.S., is
19 amended to read: 338.155 Payment of toll on toll facilities
20 required; exemptions.--
21 (1) No persons are permitted to use any toll facility
22 without payment of tolls, except employees of the agency
23 operating the toll project when using the toll facility on
24 official state business, state military personnel while on
25 official military business, handicapped persons as provided in
26 this section, persons exempt from toll payment by the
27 authorizing resolution for bonds issued to finance the
28 facility, and persons exempt on a temporary basis where use of
29 such toll facility is required as a detour route. Any law
30 enforcement officer operating a marked official vehicle is
31 exempt from toll payment when on official law enforcement

1 business. Any person operating a fire vehicle when on official
2 business or a rescue vehicle when on official business is
3 exempt from toll payment. Any person participating in the
4 funeral procession of a law enforcement officer or firefighter
5 killed in the line of duty is exempt from toll payment. The
6 secretary, or the secretary's designee, may suspend the
7 payment of tolls on a toll facility when necessary to assist
8 in emergency evacuation. The failure to pay a prescribed toll
9 constitutes a noncriminal traffic infraction, punishable as a
10 moving violation pursuant to s. 318.18. The department is
11 authorized to adopt rules relating to guaranteed toll
12 accounts.
13 Section 5. A new subsection (12) is added to section
14 339.175, F.S., to read:
15 339.175 Metropolitan planning organization.--It is the
16 intent of the Legislature to encourage and promote the safe
17 and efficient management, operation, and development of
18 surface transportation systems that will serve the mobility
19 needs of people and freight within and through urbanized areas
20 of this state while minimizing transportation-related fuel
21 consumption and air pollution. To accomplish these objectives,
22 metropolitan planning organizations, referred to in this
23 section as M.P.O.'s, shall develop, in cooperation with the
24 state and public transit operators, transportation plans and
25 programs for metropolitan areas. The plans and programs for
26 each metropolitan area must provide for the development and
27 integrated management and operation of transportation systems
28 and facilities, including pedestrian walkways and bicycle
29 transportation facilities that will function as an intermodal
30 transportation system for the metropolitan area, based upon
31 the prevailing principles provided in s. 334.046(1). The

1 process for developing such plans and programs shall provide
2 for consideration of all modes of transportation and shall be
3 continuing, cooperative, and comprehensive, to the degree
4 appropriate, based on the complexity of the transportation
5 problems to be addressed. To ensure that the process is
6 integrated with the statewide planning process, M.P.O.'s shall
7 develop plans and programs that identify transportation
8 facilities that should function as an integrated metropolitan
9 transportation system, giving emphasis to facilities that
10 serve important national, state, and regional transportation
11 functions. For the purposes of this section, those facilities
12 include the facilities on the Strategic Intermodal System
13 designated under s. 339.63.
14 (12) VOTING REQUIREMENTS.--Each long-range
15 transportation plan required pursuant to subsection (6); each
16 annually updated Transportation Improvement Program required
17 pursuant to subsection (7); and each annual unified planning
18 work program required pursuant to subsection (8) must be
19 approved by each M.P.O. on a recorded roll-call vote of the
20 membership present. Any proposed modification of a
21 Transportation Improvement Program and the annual unified
22 planning work program that affect projects in the first three
23 years of such plans or programs require a recorded roll-call,
24 super majority vote of two-thirds of the M.P.O. membership
25 present and voting.
