15 On page 3, line 24-29, delete those lines

17 and insert: undiscoverable condition created by the engineer.
18 This subsection does not affect any claim of any entity
19 against such engineer or engineering firm, which claim is
20 associated with such entity's facilities on or in Department
21 of Transportation roads or other transportation facilities.
22 (4) In any civil action for death, injury, or damages
23 against the Department of Transportation or its agents,
24 consultants, engineers or contractors for work performed on a
25 highway, road, street, bridge, or other transportation
26 facility, if the department, its agents, consultants,
27 engineers, or contractors are immune from liability pursuant
28 to this section or are not parties to the litigation, they may
29 not be named on the jury verdict form or be found to be at
30 fault or responsible for the injury, death, or damage that
31 gave rise to the damages.
