11 | indemnification under certain circumstances; requiring |
12 | notice of indoor environmental quality training |
13 | completion; requiring the State Board of Education to |
14 | adopt rules; providing an effective date. |

16 | Be It Enacted by the Legislature of the State of Florida: |
17 |
|
18 | Section 1. Section 1013.381, Florida Statutes, is created |
19 | to read: |
20 | 1013.381 Indoor environmental quality.-- |
21 | (1) Each district school board shall adopt and implement |
22 | an indoor environmental quality policy which shall provide |
23 | procedures for periodic surveys of indoor environmental quality |
24 | issues. The policy may: |
25 | (a) Be developed and implemented in accordance with the |
26 | United States Environmental Protection Agency's Indoor Air |
27 | Quality Tools for Schools Program through which training and |
28 | materials shall be provided by the United States Environmental |
29 | Protection Agency at no cost to a school or school district. |
30 | (b) Require that the school district provide, monitor, and |
31 | maintain indoor environmental condition performance in |
32 | accordance with American Society of Heating, Refrigerating and |
33 | Air-Conditioning Engineers (ASHRAE) Standard 62. |
34 | (c) Require that educational facilities be certified every |
35 | 2 years by a professional engineer as meeting ASHRAE Standard |
36 | 62. Upon certification, the school district shall be indemnified |
37 | for the life of the certificate from liability related to indoor |
38 | environmental quality. A school district shall provide a copy of |
39 | the engineer's certification to the Commissioner of Education. |
40 | (2) Each school participating in the Indoor Air Quality |
41 | Tools for Schools Program training must display its certificate |
42 | of completion in a conspicuous manner. |
43 | (3) The State Board of Education shall adopt rules to |
44 | implement the provisions of this section. |
45 | Section 2. This act shall take effect July 1, 2005. |
