2 An act relating to nurse registries; amending
3 s. 400.506, F.S.; revising requirements for
4 home visits by registered nurses; deleting a
5 mandatory requirement for monthly visits;
6 requiring that the patient be notified of the
7 availability of optional visits; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Paragraph (c) of subsection (10) of section
13 400.506, Florida Statutes, is amended to read:
14 400.506 Licensure of nurse registries; requirements;
15 penalties.--

17 (c) When a certified nursing assistant or home health
18 aide is referred to a patient's home by a nurse registry, the
19 nurse registry shall advise the patient, the patient's family,
20 or any other person acting on behalf of the patient at the
21 time the contract for services is made that registered nurses
22 are available to visit the patient's home for an additional
23 cost. A registered nurse shall make monthly visits to the
24 patient's home to assess the patient's condition and quality
25 of care being provided by the certified nursing assistant or
26 home health aide. Any condition which in the professional
27 judgment of the nurse requires further medical attention shall
28 be reported to the attending physician and the nurse registry.
29 A record of the nurse's visit The assessment shall become a
30 part of the patient's file with the nurse registry and may be
31 reviewed by the agency during their survey procedure.

1 Section 2. This act shall take effect July 1, 2005.

6 The Committee Substitute revises the circumstances under which
a nurse registry must provide the services of a registered
7 nurse to patients. When a nurse registry refers a certified
nursing assistant or home health aide to a patient's home, the
8 nurse registry must advise the patient, the patient's family,
or any other person acting on behalf of the patient that a
9 registered nurse is available to make monthly visits to the
patient's home for an additional cost.
