1 A bill to be entitled
2 An act relating to podiatric medicine; amending
3 s. 461.014, F.S.; requiring a hospital having a
4 podiatric residency program to annually provide
5 the Board of Podiatric Medicine with certain
6 information; permitting a resident podiatric
7 physician to prescribe certain medications
8 under certain circumstances; providing a
9 penalty; requiring the board to adopt rules to
10 administer this act; providing an effective
11 date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Section 461.014, Florida Statutes, is
16 amended to read:
17 461.014 Residency.--
18 (1) The board shall encourage and develop podiatric
19 residency programs in hospitals in this state and shall
20 establish such programs by the adoption promulgation of rules,
21 subject to the following conditions:
22 (a)(1) Any residency program shall be approved by the
23 Council of Podiatry Education of the American Podiatry
24 Association.
25 (b)(2) A residency program may be established only at
26 a hospital where a duly licensed podiatric physician is on the
27 hospital staff or is otherwise in a supervisory position.
28 (c)(3) Every resident shall register with the board
29 through the submission of forms provided by the board, which
30 forms shall, besides other required information, reflect the
31 date of commencement of residency.

1 (d)(4) Every hospital having a residency program shall
2 annually, on semiannually, on January 1 and July 1 of each
3 year, provide the board with a list of podiatric residents and
4 such other information as is required by the board.
5 (e)(5) A No program in residency may not shall allow a
6 resident to continue as an such, unlicensed resident, for an
7 aggregate period of time in excess of 2 years.
8 (f) A person registered as a resident podiatric
9 physician under this section may, in the normal course of his
10 or her employment, prescribe medicinal drugs described in
11 schedules set forth in chapter 893 if:
12 1. The person prescribes such medicinal drugs through
13 use of a Drug Enforcement Administration number issued to the
14 hospital or teaching hospital by which the person is employed
15 or at which the person's services are used;
16 2. The person is identified by a discrete suffix to
17 the identification number issued to such hospital; and
18 3. The use of the institutional identification number
19 and individual suffixes conforms to the requirements of the
20 federal Drug Enforcement Administration.
21 (2) Any person who willfully violates this section
22 commits a misdemeanor of the first degree, punishable as
23 provided in s. 775.082 or s. 775.083.
24 (3) The board shall adopt rules pursuant to ss.
25 120.536(1) and 120.54 as necessary to administer this section.
26 Section 2. This act shall take effect July 1, 2005.
