11  The Committee on Health Care (Rich) recommended the following
12  amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 2, between lines 23 and 24,
16  
17  insert:  
18         (3)  It is a misdemeanor of the first degree,
19  punishable as provided in s. 775.082 or s. 775.083, to
20  intentionally or willfully:
21         (a)  Tamper with or otherwise render an automated
22  external defibrillator inoperative, except during such time as
23  the automated external defibrillator is being serviced,
24  tested, repaired, or recharged or pursuant to court order.
25         (b)  Obliterate the serial number on an automated
26  external defibrillator for purposes of falsifying service
27  records.
28         (c)  Improperly service, recharge, repair, test, or
29  inspect an automated external defibrillator.
30         (d)  Use a license, permit, or inspection certificate
31  for an automated external defibrillator which was issued to

 1  another person.
 2         (e)  Hold a permit or inspection certificate for an
 3  automated external defibrillator and allow another person to
 4  use that permit or inspection certificate number.
 5         (f)  Use, or permit the use of, any license, permit, or
 6  inspection certificate by any organization or individual other
 7  than the one to whom the license, permit, or inspection
 8  certificate was issued.

12  And the title is amended as follows:
13         On page 1, line 8, after the semicolon,
14  
15  insert:
16         providing that it is a first-degree misdemeanor
17         to commit certain acts involving the misuse of
18         an automated external defibrillator or the
19         misuse of the license, permit, or inspection
20         certificate for an automated external
21         defibrillator;
