11 The Committee on Criminal Justice (Wise) recommended the
12 following amendment:

15 On page 10, lines 14-24, delete those lines
16
17 and insert:
18 (d)(c) A person who violates the provisions of
19 paragraph (a) commits a misdemeanor of the second degree,
20 punishable as provided in s. 775.082 or s. 775.083. Any
21 person who commits a second or subsequent violation commits a
22 misdemeanor of the first degree, punishable as provided in s.
23 775.082 or s. 775.083. Each day of continuing violation
24 constitutes a separate offense.
25 (e) Any person who owns, operates, or maintains an
26 unlicensed home health agency and who, within 10 working days
27 after receiving notification from the agency, fails to cease
28 operation and apply for a license under this part commits a
29 misdemeanor of the first degree, punishable as provided in s.
30 775.082 or s. 775.083. Each day of continued operation is a
31 separate offense.

1 (f) Any home health agency that fails to cease
2 operation after agency notification may be fined $500 for each
3 day of non compliance.
