5 Be It Enacted by the Legislature of the State of Florida:

7 Section 1. Section 290.00710, Florida Statutes, is
8 created to read:
9 290.00710 Enterprise zone designation for the City of
10 Lakeland.--The City of Lakeland may apply to the Office of
11 Tourism, Trade, and Economic Development for designation of
12 one enterprise zone for an area within the City of Lakeland,
13 which zone shall encompass an area up to 10 square miles. The
14 application must be submitted by December 31, 2005, and must
15 comply with the requirements of s. 290.0055. Notwithstanding
16 s. 290.0065, limiting the total number of enterprise zones
17 designated and the number of enterprise zones within a
18 population category, the Office of Tourism, Trade, and
19 Economic Development may designate one enterprise zone under
20 this section. The Office of Tourism, Trade, and Economic
21 Development shall establish the initial effective date of the
22 enterprise zone designated pursuant to this section.
23 Section 2. Section 290.0073, Florida Statutes, is
24 created to read:
25 290.0073 Enterprise zone designation for Indian River
26 County, the City of Vero Beach, and the City of
27 Sebastian.--Indian River County, the City of Vero Beach, and
28 the City of Sebastian may jointly apply to the Office of
29 Tourism, Trade, and Economic Development for designation of
30 one enterprise zone encompassing an area not to exceed 10
31 square miles. The application must be submitted by December

5 the Office of Tourism, Trade, and Economic Development may
6 designate one enterprise zone under this section. The Office
7 of Tourism, Trade, and Economic Development shall establish
8 the initial effective date of the enterprise zone designated
9 pursuant to this section.
10 Section 3. Section 290.0074, Florida Statutes, is
11 created to read:
12 290.0074 Enterprise zone designation for Sumter
13 County.--Sumter County may apply to the Office of Tourism,
14 Trade, and Economic Development for designation of one
15 enterprise zone encompassing an area not to exceed 10 square
16 miles. The application must be submitted by December 31, 2005.
17 Notwithstanding the provisions of s. 290.0065 limiting the
18 total number of enterprise zones designated and the number of
19 enterprise zones within a population category, the Office of
20 Tourism, Trade, and Economic Development may designate one
21 enterprise zone under this section. The Office of Tourism,
22 Trade and Economic Development shall establish the initial
23 effective date of the enterprise zone designated pursuant to
24 this section.
25 Section 4. Section 290.0077, Florida Statutes, is
26 created to read:
27 290.0077 Enterprise zone designation for Orange County
28 and the municipality of Apopka.--Orange County and the
29 municipality of Apopka may jointly apply to the Office of
30 Tourism, Trade, and Economic Development for designation of
31 one enterprise zone. The application must be submitted by

3 limiting the total number of enterprise zones designated and
4 the number of enterprise zones within a population category,
5 the Office of Tourism, Trade, and Economic Development may
6 designate one enterprise zone under this section. The Office
7 of Tourism, Trade, and Economic Development shall establish
8 the initial effective date of the enterprise zone designated
9 pursuant to this section.
10 Section 5. The Office of Program Policy Analysis and
11 Government Accountability shall conduct an evaluation of the
12 tax incentives available to rural enterprise zones and the
13 effectiveness of rural enterprise zones in creating jobs. In
14 particular, the evaluation must consider whether existing tax
15 and other financial incentives available under the Enterprise
16 Zone Act are appropriate for businesses located in rural
17 enterprise zones and whether incentives such as the transfer
18 of unused tax credits would enhance the effectiveness of rural
19 enterprise zones. The evaluation shall include an estimation
20 of the costs of new tax incentives. The evaluation shall also
21 identify obstacles faced by rural enterprise zones and
22 recommend possible solutions. The Office of Program Policy
23 Analysis and Government Accountability shall conduct its
24 evaluation and make a report containing its findings and
25 recommendations to the Legislature by December 1, 2005.
26 Section 6. This act shall take effect July 1, 2005.
