| 4 | power of eminent domain for public school purposes; |
| 5 | providing for future expiration; providing an effective |

| 8 | Be It Enacted by the Legislature of the State of Florida: |
| 9 |

| 10 | Section 1. A municipality may exercise the power of |
| 11 | eminent domain for the purpose of obtaining lands to be conveyed |
| 12 | by the municipality to the school board of the school district |
| 13 | within which the municipality is located if the school board of |
| 14 | that county requests in writing that the municipality obtain |
| 15 | such land for conveyance to the school board and promises to use |
| 16 | the land to establish a public school thereon. Fulfilling the |
| 17 | purpose of this section is recognized as constituting a valid |
| 18 | municipal public purpose. This section expires January 1, 2006. |
| 19 | Such expiration does not affect an action in eminent domain |
| 20 | which was filed before January 1, 2006. |
| 21 | Section 2. This act shall take effect upon becoming a law. |
