17 | Be It Enacted by the Legislature of the State of Florida: |

19 | Section 1. Section 252.81, Florida Statutes, is amended to |
20 | read: |
21 | 252.81 Part Short title.--Part II of this chapter, |
22 | consisting of ss. 252.81-252.91, may be cited as the "Florida |
23 | Emergency Planning and Community Right-to-Know Act." "Florida |
24 | Hazardous Materials Emergency Response and Community Right-to- |
25 | Know Act of 1988." |
26 | Section 2. Subsection (3) of section 252.85, Florida |
27 | Statutes, is amended to read: |
28 | 252.85 Fees.-- |
29 | (3) Any owner or operator of a facility that is required |
30 | to submit a report or filing under s. 313 of EPCRA shall pay an |
31 | annual reporting fee not to exceed $150 for those s. 313 EPCRA |
32 | listed substances in effect on January 1, 2005 1998. The |
33 | department shall establish by rule the date by which the fee is |
34 | to be paid, as well as a formula or method of determining the |
35 | applicable fee under this subsection. |
36 | Section 3. This act shall take effect July 1, 2005. |
