9pt. II of ch. 252, F.S., as the "Florida Emergency
10Planning and Community Right-to-Know Act"; amending s.
11252.85, F.S.; revising a specification with respect to
12substances for which an owner or operator of a facility
13under the federal Emergency Planning and Community Right-
14to-Know Act is required to pay an annual reporting fee;
15providing an effective date.

17Be It Enacted by the Legislature of the State of Florida:
18
19     Section 1.  Section 252.81, Florida Statutes, is amended to
20read:
21     252.81  Part Short title.--Part II of this chapter,
22consisting of ss. 252.81-252.91, may be cited as the "Florida
23Emergency Planning and Community Right-to-Know Act." "Florida
24Hazardous Materials Emergency Response and Community Right-to-
25Know Act of 1988."
26     Section 2.  Subsection (3) of section 252.85, Florida
27Statutes, is amended to read:
28     252.85  Fees.--
29     (3)  Any owner or operator of a facility that is required
30to submit a report or filing under s. 313 of EPCRA shall pay an
31annual reporting fee not to exceed $150 for those s. 313 EPCRA
32listed substances in effect on January 1, 2005 1998. The
33department shall establish by rule the date by which the fee is
34to be paid, as well as a formula or method of determining the
35applicable fee under this subsection.
36     Section 3.  This act shall take effect July 1, 2005.
