11  Senator Pruitt moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 22, between lines 10 and 11,
15  
16  insert:  
17         Section 2.  Restoration activities for the Lake
18  Okeechobee Restoration Program managed by the Department of
19  Environmental Protection, the Department of Agriculture and
20  Consumer Services, the Fish and Wildlife Conservation
21  Commission, or the South Florida Water Management District are
22  exempt from the competitive procurement requirements
23  established in section 287.057, Florida Statutes, but shall
24  comply with the provisions of s. 337.11, Florida Statutes, to
25  the extent that the entities award proposed construction,
26  operations, and maintenance work to the lowest responsible
27  bidder or to the lowest evaluated responsible bidder in a
28  time-plus-money contract. The contract may provide for an
29  incentive payment to the contractor for early completion of
30  the project or critical phases of the work and for damages to
31  be assessed against the contractor for the completion of the

 1  project or critical phases of the work in excess of the time
 2  specified. Regardless of the option elected, the protest
 3  procedures in section 120.57(3), Florida Statutes, apply to
 4  all such contracts.
