  1                      A bill to be entitled

  2         An act relating to voting; amending s.

  3         101.6103, F.S.; requiring that a mail ballot

  4         that otherwise satisfies the requirements of

  5         law for mail ballots be counted even if the

  6         elector dies after mailing the ballot but

  7         before election day; amending s. 101.657, F.S.;

  8         directing the supervisor of elections to count

  9         a ballot cast by an elector voting early even

10         if the elector dies after voting early but

11         before election day; providing an effective

12         date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Subsection (7) is added to section

17  101.6103, Florida Statutes, to read:

18         101.6103  Mail ballot election procedure.--

19         (7)  A ballot that otherwise satisfies the requirements

20  of subsection (5) shall be counted even if the elector dies

21  after mailing the ballot but before election day.

22         Section 2.  Subsection (3) is added to section 101.657,

23  Florida Statutes, to read:

24         101.657  Early voting.--

25         (3)  The supervisor of elections shall count the ballot

26  of every elector voting early even if the elector dies after

27  voting early but before election day.

28         Section 3.  This act shall take effect July 1, 2005.
