2 An act relating to the Department of Citrus;
3 amending s. 601.09, F.S.; revising and
4 reorganizing the citrus districts of the state;
5 establishing four such districts; specifying
6 the counties within each district; amending ss.
7 601.04 and 601.154, F.S., relating to the
8 membership of the Florida Citrus Commission and
9 the Citrus Stabilization Act of Florida;
10 conforming provisions to changes made by the
11 act; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Section 601.09, Florida Statutes, is
16 amended to read:
17 (Substantial rewording of section. See
18 s. 601.09, F.S., for present text.)
19 601.09 Citrus districts.--For purposes of this
20 chapter, the state is divided into four districts composed of
21 the following counties:
22 (1) Citrus District One: Levy, Alachua, Putnam, St.
23 Johns, Flagler, Marion, Citrus, Sumter, Lake, Seminole,
24 Orange, Hernando, Pasco, Pinellas, Hillsborough, Polk, and
25 Osceola Counties.
26 (2) Citrus District Two: Manatee, Hardee, DeSoto,
27 Sarasota, Charlotte, Lee, Collier, and Monroe Counties.
28 (3) Citrus District Three: Volusia, Brevard, Indian
29 River, St. Lucie, Martin, Palm Beach, Broward, and Miami-Dade
30 Counties.

1 (4) Citrus District Four: Highlands, Okeechobee,
2 Glades, and Hendry Counties.
3 Section 2. Paragraph (c) of subsection (1) and
4 subsection (4) of section 601.04, Florida Statutes, are
5 amended to read:
6 601.04 Florida Citrus Commission; creation and
7 membership.--
8 (1)
9 (c) There shall be three four members of the
10 commission from each of the four three citrus districts. Each
11 member must reside in the district from which she or he was
12 appointed. For the purposes of this section, the residence of
13 a member shall be the actual physical and permanent residence
14 of the member.
15 (4) It is the intent of the Legislature that the
16 commission be redistricted every 5 years. Redistricting shall
17 be based on the total boxes produced from each of the four
18 three districts during that 5-year period.
19 Section 3. Paragraph (a) of subsection (4) of section
20 601.154, Florida Statutes, is amended to read:
21 601.154 Citrus Stabilization Act of Florida.--
22 (4)(a) Every marketing order issued pursuant to the
23 provisions of this section shall provide for an advisory
24 council to advise the Department of Citrus in the
25 administration thereof. Two members of such advisory council
26 shall be appointed by the commission chair, subject to
27 commission concurrence, from each of the four three citrus
28 districts as defined in s. 601.09 from producer nominees
29 submitted by producers on or before the date of the hearing
30 provided for in subsection (2). To qualify for appointment,
31 such producer nominees shall meet the same qualifications as

3 Section 4. This act shall take effect July 1, 2005.
