A bill to be entitled
2An act relating to the Board of Medicine; amending s.
3458.307, F.S.; revising membership requirements; providing
4for expiration of terms of current members, appointment of
5new members to staggered terms, and appointment and terms
6of successors; providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Subsections (2) and (3) of section 458.307,
11Florida Statutes, are amended to read:
12     458.307  Board of Medicine.--
13     (2)  Ten Twelve members of the board must be licensed
14physicians in good standing in this state who are residents of
15the state and who have been engaged in the active practice or
16teaching of medicine in this state with a full and unrestricted
17medical license for at least 5 4 years immediately preceding
18their appointment. One of the physicians must be on the full-
19time faculty of a medical school in this state, and one of the
20physicians must be in private practice and on the full-time
21staff of a statutory teaching hospital in this state as defined
22in s. 408.07. At least one of the physicians must be a graduate
23of a foreign medical school. Four consumer members The remaining
24three members must be residents of the state who have lived in
25the state for at least 5 years immediately preceding their
26appointments, have never been licensed as a health care
27practitioner under chapter 456 or the applicable practice act,
28and do not have a substantial personal, business, professional,
29or pecuniary connection with a licensed health care practitioner
30or with a medical education or health care facility, except as
31patients or potential patients are not, and never have been,
32licensed health care practitioners. The final One member must be
33the chief operations officer of a hospital a health care risk
34manager licensed under chapter 395 who has lived in the state
35and held this position for at least 5 years immediately
36preceding his or her appointment s. 395.10974. At least one
37member of the board must be 60 years of age or older.
38     (3)  Terms for current members of the board shall expire on
39October 31, 2005. Initial appointments to the board pursuant to
40this act shall take effect November 1, 2005. Five of the initial
41physician appointments shall be for a term of 2 years; five of
42the initial physician appointments shall be for a term of 3
43years; and the remaining initial appointments shall be for a
44term of 4 years. As the terms of the members expire subsequent
45to November 1, 2005, the Governor shall appoint successors for
46terms of 4 years, and such members shall serve until their
47successors are appointed.
48     Section 2.  This act shall take effect upon becoming a law.
