8 | Be It Enacted by the Legislature of the State of Florida: |
9 |

10 | Section 1. Subsections (2) and (3) of section 458.307, |
11 | Florida Statutes, are amended to read: |
12 | 458.307 Board of Medicine.-- |
13 | (2) Ten Twelve members of the board must be licensed |
14 | physicians in good standing in this state who are residents of |
15 | the state and who have been engaged in the active practice or |
16 | teaching of medicine in this state with a full and unrestricted |
17 | medical license for at least 5 4 years immediately preceding |
18 | their appointment. One of the physicians must be on the full- |
19 | time faculty of a medical school in this state, and one of the |
20 | physicians must be in private practice and on the full-time |
21 | staff of a statutory teaching hospital in this state as defined |
22 | in s. 408.07. At least one of the physicians must be a graduate |
23 | of a foreign medical school. Four consumer members The remaining |
24 | three members must be residents of the state who have lived in |
25 | the state for at least 5 years immediately preceding their |
26 | appointments, have never been licensed as a health care |
27 | practitioner under chapter 456 or the applicable practice act, |
28 | and do not have a substantial personal, business, professional, |
29 | or pecuniary connection with a licensed health care practitioner |
30 | or with a medical education or health care facility, except as |
31 | patients or potential patients are not, and never have been, |
32 | licensed health care practitioners. The final One member must be |
33 | the chief operations officer of a hospital a health care risk |
34 | manager licensed under chapter 395 who has lived in the state |
35 | and held this position for at least 5 years immediately |
36 | preceding his or her appointment s. 395.10974. At least one |
37 | member of the board must be 60 years of age or older. |
38 | (3) Terms for current members of the board shall expire on |
39 | October 31, 2005. Initial appointments to the board pursuant to |
40 | this act shall take effect November 1, 2005. Five of the initial |
41 | physician appointments shall be for a term of 2 years; five of |
42 | the initial physician appointments shall be for a term of 3 |
43 | years; and the remaining initial appointments shall be for a |
44 | term of 4 years. As the terms of the members expire subsequent |
45 | to November 1, 2005, the Governor shall appoint successors for |
46 | terms of 4 years, and such members shall serve until their |
47 | successors are appointed. |
48 | Section 2. This act shall take effect upon becoming a law. |
