7458.307, F.S.; revising membership requirements; providing
8for the appointment of an additional member; providing
9applicability to current members; providing the beginning
10date for the term of the additional member; providing an
11effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  Subsections (1) and (2) of section 458.307,
16Florida Statutes, are amended to read:
17     458.307  Board of Medicine.--
18     (1)  There is created within the department the Board of
19Medicine, composed of 16 15 members appointed by the Governor
20and confirmed by the Senate.
21     (2)  Twelve members of the board must be licensed
22physicians in good standing in this state who are residents of
23the state and who have been engaged in the active practice or
24teaching of medicine in this state with a full and unrestricted
25medical license for at least 5 4 years immediately preceding
26their appointment. One of the physicians must be on the full-
27time faculty of a medical school in this state, and one of the
28physicians must be in private practice and on the full-time
29staff of a statutory teaching hospital in this state as defined
30in s. 408.07. At least one of the physicians must be a graduate
31of a foreign medical school. The remaining four three members
32must be residents of the state who have lived in the state for
33at least 5 years immediately preceding their appointments, have
34never been licensed as a health care practitioner under chapter
35456 or the applicable practice act, and do not have a
36substantial personal, business, professional, or pecuniary
37connection with a licensed health care practitioner or with a
38medical education or health care facility, except as patients or
39potential patients are not, and never have been, licensed health
40care practitioners. One member must be a health care risk
41manager licensed under s. 395.10974. At least one member of the
42board must be 60 years of age or older.
43     Section 2.  The requirements of section 458.307, Florida
44Statutes, as amended by this act, shall apply to appointments
45made on or after the effective date of this act and shall not be
46construed to end the term of any member of the Board of Medicine
47holding that appointment on the effective date of this act. The
48term of the additional member required to be appointed under
49section 458.307, Florida Statutes, as amended by this act, shall
50begin November 1, 2005.
51     Section 3.  This act shall take effect upon becoming a law.
