12 the following amendment:

15 On page 7, between lines 15 and 16,

17 insert:
18 (9)(a) Notwithstanding any provision of this section,
19 if an Eminent Scholar Endowed Chair is vacant for more than 12
20 months, the donor may request that the gift be returned to the
21 donor and the gift shall be returned to the donor immediately
22 or the donor may request that the gift be transferred to
23 another designated university that expresses a willingness to
24 immediately employ a person to occupy the chair and the gift
25 shall be transferred to that designated university.
26 (b) If the donor transfers the gift to another
27 university eligible to participate in the program, the state
28 matching funds previously matched to the donation must be
29 transferred to the university receiving the transferred gift.
30 (c) If the university from which the gift and matching
31 funds are transferred has entered into a contract with a

1 person to serve as the eminent scholar but the person has not
2 begun to serve as the employed eminent scholar, then the
3 contract, and the funds associated with it, must be delivered
4 to the designated university to which the gift and matching
5 funds are transferred. In all other circumstances, the state
6 matching funds received on a returned or transferred gift
7 shall revert to General Revenue.
8 (d) For the purposes of this subsection, the term
9 "vacant" means that no person has been employed and serving
10 full time as the eminent scholar or that the university has
11 not designated an eminent scholar chair for a specific purpose
12 consistent with the intent of the donor.

17 On page 1, line 22, after the semicolon,

19 insert:
