8 | Be It Enacted by the Legislature of the State of Florida: |

10 | Section 1. Subsection (14) of section 1002.42, Florida |
11 | Statutes, is amended to read: |
12 | 1002.42 Private schools.-- |
13 | (14) BUS DRIVER REQUIREMENTS AND TRAINING.-- |
14 | (a) Each private school bus driver must be of good moral |
15 | character, have good vision and hearing, and be able-bodied, |
16 | free from communicable disease, mentally alert, and sufficiently |
17 | strong physically to handle the bus with ease; must possess |
18 | other qualifications described in 49 C.F.R. part 391, relating |
19 | to physical qualifications and examinations, and in 49 C.F.R. |
20 | parts 40 and 382, relating to controlled substance and alcohol |
21 | use and testing; must meet level 2 background screening |
22 | standards set forth in chapter 435; and must hold a valid |
23 | chauffeur registration or a valid commercial driver's license |
24 | with a passenger endorsement. |
25 | (b) Private school bus drivers may participate in a |
26 | district school board's bus driver training program, if the |
27 | district school board makes the program available pursuant to s. |
28 | 1012.45(4). |
29 | Section 2. This act shall take effect July 1, 2005. |
