11licensure; providing responsibilities relating to
12background screening; providing for reimbursement of
13costs; providing for applicability; providing an effective
14date.

16Be It Enacted by the Legislature of the State of Florida:
17
18     Section 1.  Section 125.5805, Florida Statutes, is created
19to read:
20     125.5805  For-hire bus drivers; transport of school
21students; required local ordinances; minimum requirements;
22reimbursement of costs; exclusion.--
23     (1)  No later than January 1, 2006, all counties must adopt
24an ordinance that requires every driver of a motor vehicle that
25is regularly used for the transportation of students to or from
26school, or to or from school activities, who receives
27compensation for such services to register with the county.
28     (2)  The ordinance shall require, at a minimum, that by
29January 1, 2006, each driver:
30     (a)  Must meet level 2 background screening standards as
31set forth in chapter 435. The county shall submit the
32fingerprints of each driver to the Department of Law Enforcement
33for state processing and the Department of Law Enforcement shall
34forward the fingerprints to the Federal Bureau of Investigation
35for national processing. The Department of Law Enforcement shall
36render an invoice to the county for the fingerprints submitted
37each month. The county shall screen background results to
38determine if the applicant meets the level 2 background
39screening standards.
40     (b)  Must hold a valid commercial driver's license with a
41passenger endorsement.
42     (3)  Each driver shall reimburse the county for any costs
43of background screening or for any other expenses related to
44administration of the ordinance.
45     (4)  The provisions of this section shall not apply to
46drivers employed by a public school or private school who meet
47the requirements of s. 1012.45 or s. 1002.42.
48     Section 2.  This act shall take effect July 1, 2005.
