16 | Be It Enacted by the Legislature of the State of Florida: |
17 |

18 | Section 1. Section 125.5805, Florida Statutes, is created |
19 | to read: |
20 | 125.5805 For-hire bus drivers; transport of school |
21 | students; required local ordinances; minimum requirements; |
22 | reimbursement of costs; exclusion.-- |
23 | (1) No later than January 1, 2006, all counties must adopt |
24 | an ordinance that requires every driver of a motor vehicle that |
25 | is regularly used for the transportation of students to or from |
26 | school, or to or from school activities, who receives |
27 | compensation for such services to register with the county. |
28 | (2) The ordinance shall require, at a minimum, that by |
29 | January 1, 2006, each driver: |
30 | (a) Must meet level 2 background screening standards as |
31 | set forth in chapter 435. The county shall submit the |
32 | fingerprints of each driver to the Department of Law Enforcement |
33 | for state processing and the Department of Law Enforcement shall |
34 | forward the fingerprints to the Federal Bureau of Investigation |
35 | for national processing. The Department of Law Enforcement shall |
36 | render an invoice to the county for the fingerprints submitted |
37 | each month. The county shall screen background results to |
38 | determine if the applicant meets the level 2 background |
39 | screening standards. |
40 | (b) Must hold a valid commercial driver's license with a |
41 | passenger endorsement. |
42 | (3) Each driver shall reimburse the county for any costs |
43 | of background screening or for any other expenses related to |
44 | administration of the ordinance. |
45 | (4) The provisions of this section shall not apply to |
46 | drivers employed by a public school or private school who meet |
47 | the requirements of s. 1012.45 or s. 1002.42. |
48 | Section 2. This act shall take effect July 1, 2005. |
