9     Substitute Amendment for Amendment (314177) (with title
10amendment)
11On page 1, between line(s) 28 and 29, insert:
12     Section 3.  The amendments made to section 393.0661,
13Florida Statutes, by the Conference Committee Report on
14Committee Substitute for Committee Substitute for Senate Bill
15404 are repealed.
16     Section 4.  The amendments made to section 409.907,
17Florida Statutes, by the Conference Committee Report on
18Committee Substitute for Committee Substitute for Senate Bill
19404 are repealed.
20     Section 5.  The amendments made to the introductory
21provision only of section 409.908, Florida Statutes, by the
22Conference Committee Report on Committee Substitute for
23Committee Substitute for Senate Bill 404 are repealed.
24     Section 6.  Section 409.9082, Florida Statutes, as created
25by the Conference Committee Report on Committee Substitute for
26Committee Substitute for Senate Bill 404, is repealed.
27     Section 7.  Section 23 of the Conference Committee Report
28on Committee Substitute for Committee Substitute for Senate Bill
29404 is repealed.
30     Section 8.  Subsection (2) of section 409.9124, F.S., as
31amended by section 18 of the Conference Committee Report on
32Committee Substitute for Committee Substitute for Senate Bill
33404 is amended to read:
34     409.9124  Managed care reimbursement.--
35     (2)  Each year prior to establishing new managed care
36rates, the agency shall review all prior year adjustments for
37changes in trend, and shall reduce or eliminate those
38adjustments which are not reasonable and which reflect policies
39or programs which are not in effect. In addition, the agency
40shall apply only those policy reductions applicable to the
41fiscal year for which the rates are being set, which can be
42accurately estimated and verified by an independent actuary, and
43which have been implemented prior to or will be implemented
44during the fiscal year. The agency shall pay rates at per-
45member, per-month averages that equal, but do not exceed, the
46amounts allowed for in the General Appropriations Act applicable
47to the fiscal year for which the rates will be in effect;
48however, in no event shall the agency pay rates that exceed on
49an average statewide basis 92 percent of the Medicaid fee-for-
50service expenditures for comparable groups of Medicaid
51recipients based on the provisions of this section.
