| 5 | A bill to be entitled |
| 6 | An act relating to police dogs, fire dogs, SAR dogs, and |
| 7 | police horses; amending s. 843.19, F.S.; prohibiting |
| 8 | intentionally and knowingly, without justification, |
| 9 | causing great bodily harm to or using a deadly weapon upon |
| 10 | a police dog, fire dog, SAR dog, or police horse; |
| 11 | prohibiting actually and intentionally maliciously |
| 12 | touching, striking, or causing bodily harm to a police |
| 13 | dog, fire dog, SAR dog, or police horse; prohibiting |
| 14 | maliciously harassing, teasing, interfering with, or |
| 15 | attempting to interfere with a police dog, fire dog, SAR |
| 16 | dog, or police horse while the animal is in the |
| 17 | performance of its duties; providing penalties; providing |
| 18 | for restitution from violators; providing application; |
| 19 | providing an effective date. |

| 21 | Be It Enacted by the Legislature of the State of Florida: |
| 22 |
|
| 23 | Section 1. Subsection (2) of section 843.19, Florida |
| 24 | Statutes, is amended, and subsections (3), (4), and (5) are |
| 25 | added to said section, to read: |
| 26 | 843.19 Offenses against Injuring or killing police dogs |
| 27 | dog, fire dogs dog, SAR dogs dog, or police horses horse |
| 28 | prohibited; penalty.-- |
| 29 | (2) Any person who intentionally and knowingly, and |
| 30 | willfully and without lawful cause or justification, causes |
| 31 | great inflicts bodily harm, permanent disability, or death to, |
| 32 | or uses a deadly weapon upon, a police dog, fire dog, SAR dog, |
| 33 | or police horse commits a felony of the third degree, punishable |
| 34 | as provided in s. 775.082, s. 775.083, or s. 775.084. |
| 35 | (3) Any person who actually and intentionally maliciously |
| 36 | touches, strikes, or causes bodily harm to a police dog, fire |
| 37 | dog, SAR dog, or police horse commits a misdemeanor of the first |
| 38 | degree, punishable as provided in s. 775.082 or s. 775.083. |
| 39 | (4) Any person who intentionally or knowingly maliciously |
| 40 | harasses, teases, interferes with, or attempts to interfere with |
| 41 | a police dog, fire dog, SAR dog, or police horse while the |
| 42 | animal is in the performance of its duties commits a misdemeanor |
| 43 | of the second degree, punishable as provided in s. 775.082 or s. |
| 44 | 775.083. |
| 45 | (5) A person convicted of an offense under this section |
| 46 | shall make restitution for injuries caused to the police dog, |
| 47 | fire dog, SAR dog, or police horse and shall pay the replacement |
| 48 | cost of the animal if, as a result of the offense, the animal |
| 49 | can no longer perform its duties. |
| 50 | Section 2. This act shall take effect October 1, 2005, and |
| 51 | shall apply to offenses occurring on or after that date. |
