15         On page 9, line 3, through page 10, line 13 delete
16  those lines
17  
18  and insert:  
19         (17)  The board of directors and officers of the
20  corporation are responsible for the prudent use of all public
21  and private funds that the corporation controls and must
22  ensure that the use of such funds is in accordance with
23  applicable laws, bylaws, and contractual requirements. An
24  employee of the corporation may not receive compensation for
25  employment which exceeds the salary paid to the Governor,
26  unless the board of directors and the employee have executed a
27  contract that prescribes specific, measurable performance
28  outcomes for the employee, the satisfaction of which provides
29  the basis for the award of incentive payments that increase
30  the employee's total compensation to a level above the salary
31  paid to the Governor.

Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 592 Barcode 070182 1 (18) The credit of the State of Florida may not be 2 pledged on behalf of the corporation. 3 (19) In addition to any indemnification available 4 under chapter 617, Florida Statutes, the corporation may 5 indemnify, and purchase and maintain insurance on behalf of, 6 its directors, officers, employees, or working-group members 7 against personal liability or accountability for actions taken 8 within the scope of their employment or authority. 9 (20) By December 1 each year, the corporation must 10 submit an annual report to the Governor, the President of the 11 Senate, the Speaker of the House of Representatives, and the 12 chairman of the State Board of Education containing: 13 (a) A detailed description of the corporation's 14 activities and accomplishments for the year. 15 (b) An annual financial accounting of resources and 16 expenditures prepared by an independent certified public 17 accountant. 18 (c) A statement of the strategic priorities of the 19 corporation and their use in guiding resource allocations. 20 (d) Any recommendations the corporation has for action 21 by the Legislature or by the agencies of state, county, or 22 municipal governments to foster research concerning, or 23 development or deployment of, alternative energy technology. 24 25 26 27 28 29 30 31 2 8:57 AM 03/28/05 s0592.ep03.002
