1 A bill to be entitled
2 An act relating to funding for school
3 districts; amending s. 1011.715, F.S.;
4 providing that a resolution of a district
5 school board providing for the receipt of
6 proceeds of the local government infrastructure
7 surtax authorized under s. 212.055(2), F.S.,
8 may include a covenant to decrease capital
9 local school property taxes or to discontinue
10 the surtax in certain circumstances; providing
11 an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Section 1011.715, Florida Statutes, is
16 amended to read:
17 1011.715 Resolution regarding school capital outlay
18 surcharge or local government infrastructure surtax.--The
19 resolution of a district school board providing for the
20 imposition of the school capital outlay surtax authorized in
21 s. 212.055(6) or providing for the receipt of proceeds of the
22 local government infrastructure surtax authorized under s.
23 212.055(2) may include a covenant by the district school board
24 to decrease the capital local school property tax levied
25 pursuant to s. 1011.71(2) and to maintain that tax at the
26 reduced millage as long as the surtax is in effect. The
27 resolution may also provide that the surtax shall sunset on
28 December 31 of any year in which the district school board
29 levies the capital property tax under s. 1011.71(2) at a
30 millage rate in excess of the reduced millage rate promised in
31 the resolution. Finally, if the surtax revenues are pledged

1 to service bonded indebtedness, the district school board may
2 covenant not to levy the capital property tax under s.
3 1011.71(2) at a millage rate in excess of the reduced millage
4 rate promised in the resolution.
5 Section 2. This act shall take effect upon becoming a
6 law.
