14 Delete everything after the resolving clause

16 and insert: That the amendment to Section 5 of Article XI of
17 the State Constitution set forth below is agreed to and shall
18 be submitted to the electors of Florida for approval or
19 rejection at the general election to be held in November 2006:
20 ARTICLE XI
21 AMENDMENTS
22 Section 5. Amendment or revision election.--
23 (a) A proposed amendment to or revision of this
24 constitution, or any part of it, shall be submitted to the
25 electors at the next general election held more than ninety
26 days after the joint resolution or report of revision
27 commission, constitutional convention or taxation and budget
28 reform commission proposing it is filed with the custodian of
29 state records, unless, pursuant to law enacted by the
30 affirmative vote of three-fourths of the membership of each
31 house of the legislature and limited to a single amendment or

1 revision, it is submitted at an earlier special election held
2 more than ninety days after such filing.
3 (b) A proposed amendment or revision of this
4 constitution, or any part of it, by initiative shall be
5 submitted to the electors at the general election provided the
6 initiative petition is filed with the custodian of state
7 records no later than February 1 of the year in which the
8 general election is held.
9 (c) The legislature shall provide by general law,
10 prior to the holding of an election pursuant to this section,
11 for the provision of a statement to the public regarding the
12 probable financial impact of any amendment proposed by
13 initiative pursuant to section 3.
14 (d) Once in the tenth week, and once in the sixth week
15 immediately preceding the week in which the election is held,
16 the proposed amendment or revision, with notice of the date of
17 election at which it will be submitted to the electors, shall
18 be published in one newspaper of general circulation in each
19 county in which a newspaper is published.
20 (e) Unless otherwise specifically provided for
21 elsewhere in this constitution, if the proposed amendment or
22 revision is approved by vote of at least sixty percent of the
23 electors voting on the measure, it shall be effective as an
24 amendment to or revision of the constitution of the state on
25 the first Tuesday after the first Monday in January following
26 the election, or on such other date as may be specified in the
27 amendment or revision.
28 BE IT FURTHER RESOLVED that the title and substance of
29 the amendment proposed herein shall appear on the ballot as
30 follows:

1 CONSTITUTIONAL AMENDMENTS OR REVISIONS
2 Proposes an amendment to Section 5 of Article XI of the
3 State Constitution to require that any proposed amendment to
4 or revision of the State Constitution, whether proposed by the
5 Legislature, by initiative, or by any other method, must be
6 approved by at least 60 percent of the voters of the state
7 voting on the measure, rather than by a simple majority. This
8 proposed amendment would not change the current requirement
9 that a proposed constitutional amendment imposing a new state
10 tax or fee be approved by at least 2/3 of the voters of the
11 state voting in the election in which such an amendment is
12 considered.
