17 That the following amendment to Sections 3 and 5 of
18 Article XI of the State Constitution is agreed to and shall be
19 submitted to the electors of this state for approval or
20 rejection at the next general election or at an earlier
21 special election specifically authorized by law for that
22 purpose:
23 ARTICLE XI
24 AMENDMENTS
25 SECTION 3. Initiative.--The power to propose the
26 revision or amendment of any portion or portions of this
27 constitution or to propose legislation by initiative is
28 reserved to the people, provided that, any such revision, or
29 amendment, or legislation, except for those limiting the power
30 of government to raise revenue, shall embrace but one subject
31 and matter directly connected therewith.

1 (a) The power to propose the revision or amendment of
2 this constitution by initiative It may be invoked by filing
3 with the custodian of state records a petition containing a
4 copy of the proposed revision or amendment, signed by a number
5 of electors in each of one half of the congressional districts
6 of the state, and of the state as a whole, equal to eight
7 percent of the votes cast in each of such districts
8 respectively and in the state as a whole in the last preceding
9 election in which presidential electors were chosen.
10 (c) The power to propose legislation by initiative may
11 be invoked by filing with the custodian of state records a
12 petition containing a copy of the proposed legislation, signed
13 by a number of electors equal to four percent of the votes
14 cast in the state as a whole in the last preceding election in
15 which presidential electors were chosen.
16 SECTION 5. Amendment or revision election.--
17 (a) A proposed amendment to or revision of this
18 constitution, or any part of it, or any legislation proposed
19 by initiative shall be submitted to the electors at the next
20 general election held more than ninety days after the joint
21 resolution or report of revision commission, constitutional
22 convention or taxation and budget reform commission proposing
23 it is filed with the custodian of state records, unless,
24 pursuant to law enacted by the affirmative vote of
25 three-fourths of the membership of each house of the
26 legislature and limited to a single amendment or revision, it
27 is submitted at an earlier special election held more than
28 ninety days after such filing.
29 (b) A proposed amendment or revision of this
30 constitution, or any part of it, or any legislation by
31 initiative shall be submitted to the electors at the general

1 election provided the initiative petition is filed with the
2 custodian of state records no later than February 1 of the
3 year in which the general election is held.
4 (c) The legislature shall provide by general law,
5 prior to the holding of an election pursuant to this section,
6 for the provision of a statement to the public regarding the
7 probable financial impact of any amendment or legislation
8 proposed by initiative pursuant to section 3.
9 (d) Once in the tenth week, and once in the sixth week
10 immediately preceding the week in which the election is held,
11 the proposed amendment or revision or the proposed
12 legislation, with notice of the date of election at which it
13 will be submitted to the electors, shall be published in one
14 newspaper of general circulation in each county in which a
15 newspaper is published. In the alternative, the secretary of
16 state may mail to every registered voter a pamphlet containing
17 the proposed amendment and statements of no more than 500
18 words prepared by one proponent and one opponent of the
19 initiative. Such pamphlet may be included in any mailing of
20 sample ballots.
21 (e) If the proposed amendment or revision is approved
22 by vote of at least three-fifths of the electors voting on the
23 measure, it shall be effective as an amendment to or revision
24 of the constitution of the state on the first Tuesday after
25 the first Monday in January following the election, or on such
26 other date as may be specified in the amendment or revision.
27 (f) Unless otherwise specifically provided in this
28 constitution, if the proposed legislation by initiative is
29 approved by a majority of the electors of the state voting on
30 the measure, it shall take effect on the first Tuesday after
31 the first Monday in January following the election, or on such

1 other date as may be specified in the legislation.
2 (g) Legislation approved by the voters under this
3 section may not be amended or repealed except by an
4 affirmative vote of three-fourths of the membership of each
5 house of the legislature.
6 BE IT FURTHER RESOLVED that the following statement be
7 placed on the ballot:
8 CONSTITUTIONAL AMENDMENT
9 ARTICLE XI, SECTIONS 3 and 5
10 INITIATIVE AND APPROVAL OF CONSTITUTIONAL AMENDMENTS OR
11 REVISIONS.--Proposing an amendment to the State Constitution
12 to allow the proposal of legislation by initiative and
13 establishing procedures and requirements for such initiatives
14 and to require that a proposed constitutional amendment or
15 revision be approved by at least three-fifths of the electors
16 of the state voting on the measure rather than by a simple
17 majority.
