| 5 | 1. The agency may set standards for pharmacy benefits for |
| 6 | managed care plans and specify the therapeutic classes of |
| 7 | pharmacy benefits to enable a plan to coordinate and fully |
| 8 | manage all aspects of patient care as part of the plan or |
| 9 | through a pharmacy benefits manager. |
| 10 | 2. Each plan shall implement a pharmacy fraud, waste, and |
| 11 | abuse initiative that may include a surety bond or letter of |
| 12 | credit requirement for participating pharmacies, enhanced |
| 13 | provider auditing practices, the use of additional fraud and |
| 14 | abuse software, recipient management programs for recipients |
| 15 | inappropriately using their benefits, and other measures to |
| 16 | reduce provider and recipient fraud, waste, and abuse. The |
| 17 | initiative shall address enforcement efforts to reduce the |
| 18 | number and use of counterfeit prescriptions. |
| 19 | 3. The agency shall require plans to report incidences of |
| 20 | pharmacy fraud and abuse and establish procedures for receiving |
| 21 | and investigating fraud and abuse reports from plans in the |
| 22 | demonstration project sites. Plans must report instances of |
| 23 | fraud and abuse pursuant to chapter 641, Florida Statutes. |
